Resolution No. 22-1266 <br /> Page 2 of 3 <br /> located within the the boundaries of the cities of Dublin, Livermore, and Pleasanton, the Town of <br /> Danville, and those portions of the unincorporated areas of Contra Costa and Alameda Counties, <br /> which include the communities of Alamo, Blackhawk, and Sunol, the portion of the counties that <br /> lies between the cities of Pleasanton and Livermore, and that portion of Alameda County which <br /> lies southeast of Interstate 580, as shown on the map attached as Exhibit B. <br /> Section 6. The name of the district shall be Tri-Valley Tourism Marketing District <br /> (MMD). <br /> Section 7. The annual assessment rate is three dollars and twenty-five cents ($3.25) <br /> of gross short-term room rental revenue. Based on the benefit received, assessments will not be <br /> collected on: stays of more than thirty (30) consecutive days, nor on stays by any Federal or State <br /> of California officer or employee when on official business who makes a claim that they are <br /> exempt, nor on stays by any officer or employee of a foreign government who is exempt by reason <br /> of express provision of federal law or international treaty. The annual assessment rate may be <br /> subject to an increase each year starting in the third year,the amount of which shall be determined <br /> by the Visit Tri-Valley Board, as described in the Plan. The total assessment rate may not exceed <br /> four dollars ($4.00). <br /> Section 8. The assessments levied for the TVTMD shall be applied toward sales & <br /> marketing and destination development programs to market assessed businesses in the Tri- <br /> Valley area as tourist, meeting, and event destinations, as described in the Plan. Funds remaining <br /> at the end of any year may be used in subsequent years in which MMD assessments are levied <br /> as long as they are used consistent with the requirements of this resolution and the Plan. <br /> Section 9. The TVTMD will have a ten-year term, beginning on July 1, 2022, and end <br /> on June 30, 2032, unless renewed pursuant to Streets and Highways Code § 36660. <br /> Section 10. Bonds may be issued. <br /> Section 11. The time and place for the public meeting to hear testimony on establishing <br /> the MMD and levying assessments are set for March 15, 2022, at 7:00 PM, or as soon <br /> thereafter as the matter may be heard, at the Council Chambers located at 200 Old Bernal <br /> Avenue, Pleasanton, CA 94566. <br /> Section 12. The time and place for the public hearing to establish the MMD and the <br /> levy of assessments are set for April 19, 2022, at 7:00 PM, or as soon thereafter as the matter <br /> may be heard, at the Council Chambers located at 200 Old Bernal Avenue, Pleasanton, CA <br /> 94566. The City Clerk is directed to provide written notice to the businesses subject to <br /> assessment of the date and time of the meeting and hearing, and to provide that notice as required <br /> by Streets and Highways Code § 36623, no later than January 19, 2022. <br /> Section 13. At the public meeting and hearing the testimony of all interested persons <br /> for or against the renewal of the MMD may be received. If at the conclusion of the public <br /> hearing, there are of record written protests by the owners of the assessed businesses within the <br /> renewed TVTMD that will pay more than fifty percent (50%) of the estimated total assessment of <br /> the entire TVTMD, no further proceedings to renew the TVTMD shall occur for a period of one (1) <br /> year. <br /> Section 14. The complete Plan is on file with the City Clerk and may be reviewed upon <br /> request. <br />
