proposed initiative were to pass, a city or county could adopt a local ordinance that would override these current state laws and requirements. • The requirement to have a mandatory safety element for the protection from the risk of seismic hazards, wildland and urban fires (including very high fire hazard severity zones), flooding, local hazard mitigation plan; and • A mandatory environmental justice element that identifies disadvantaged communities in order to reduce health risks, promote civic engagement, and prioritize improvements and programs that address the needs of disadvantaged communities; and • A mandatory conservation element for the conservation, development and utilization of natural resources, including water, forests, soils, rivers, fisheries, wildlife, and minerals; and • A circulation element that identifies general location and extent of existing roads, ports, and transportation correlated with the land use element, taking into consideration bicyclists, children, persons with disabilities, motorists, pedestrians, users of public transportation; and • A prohibition on local ordinances that create barriers to solar energy systems; and • Administrative approval of electric vehicle charging stations. Housing-related The initiative includes local land use and zoning issues that are housing-related. Below is a list of current state laws and requirements for cities and counties. If the proposed initiative were to pass, a city or county could adopt a local ordinance that would override these current state laws and requirements. • To require the allowance of ADUs/JADUs; and • To allow the rebuilding of multifamily dwellings destroyed by fire; and • To zone sufficient land for housing; to prohibit subdivision standards that preclude housing for all economic segments of the community; and • To provide ministerial approval of housing on certain infill sites (SB 35); and • To provide ministerial approval of up to four units and lot splits (SB 9); and • To follow the Costa-Hawkins Rental Housing Act which places limits on municipal rent control ordinances by prohibiting rent control for single-family, condominiums and newly constructed apartments; and • To follow the Permit Streamlining Act which governs the approval process that a city or county is required to follow when approving a permit for construction, reconstruction for a development project, wireless telecommunication facility, or siting application for a wireless telecommunication facility; and • To follow the Mitigation Fee Act which authorizes local agencies to establish or impose a variety of fees, dedications, reservations or other exactions for services, in the connection with the approval of a development project.
