6 <br /> THE CITY OF <br /> ® : CITY COUNCIL AGENDA REPORT <br /> pLEASANTON. <br /> January 4, 2022 <br /> City Manager <br /> TITLE: DISCUSSION REGARDING PROPOSED BALLOT MEASURE 21-0016 <br /> AMENDMENT 1 WHICH PROVIDES THAT LOCAL LAND USE AND <br /> ZONING LAWS OVERRIDE CONFLICTING STATE LAWS, AND CONSIDER <br /> TAKING A POSITION <br /> SUMMARY <br /> The proposed Initiative 21-0016 would provide that any local ordinances, regulations, or <br /> charter provisions in regard to land use or zoning within the boundaries of a county or <br /> city would prevail over state law if a conflict exists. The initiative addresses both <br /> housing-related and non-housing related regulations, as well as voter initiatives related <br /> to land use or zoning. Included in this report is a summary of the Initiative 21-0016 <br /> provided by the State Attorney General, an analysis of fiscal impact by the California <br /> Legislative Analyst's Office, and a summary by the City's advocacy partner—the <br /> League of California Cities (Cal Cities). <br /> RECOMMENDATION <br /> Staffs recommends the City Council receive the overview of the proposed ballot <br /> measure Initiative 21-0016, but at this time refrain from taking any action or position to <br /> allow for further study to identify any potential consequences. <br /> FINANCIAL STATEMENT <br /> There is no financial impact. <br />
