• Parklets cannot conflict with or obstruct utility access points (e.g., manhole covers, <br /> vaults, storm drain inlets, well covers, etc.). <br /> • In the event of necessary utility repairs or maintenance that conflicts with the parklet, <br /> the City may ask the applicant to remove the parklet. <br /> Street Cleaning and Maintenance <br /> Currently, street cleaning within the downtown occurs two times per week with a deeper street <br /> cleaning occurring annually (e.g., power washing). Parklet platforms will make this baseline <br /> street cleaning more difficult. Parklet applicants will be required to maintain the area on, <br /> around, and beneath their parklet to avoid on-going issues that may arise from inadequate <br /> maintenance (e.g., drain clogged due to leaf piles). At times, the City may need to perform <br /> more extensive work on City streets so parklets may need to be removed in those instances. <br /> Staff suggests the following be built into the Parklet Agreement: <br /> • Applicants must maintain the parklet including watering plants, removing garbage, <br /> securing elements of the parklet at night, and any other required care of the parklet. <br /> • Applicants must keep area on, around, and beneath parklet clear of leaves and debris <br /> which may include blowing underneath the parklets or partial parklet removal to access <br /> the area beneath the parklets. <br /> • Applicants must power wash underneath parklets annually. <br /> • Applicants must install trash guard on nearby storm drains. A trash guard that lays on <br /> top of the grate and is attached with heavy duty zip ties or tie wire. Below grate <br /> protection is not allowed. <br /> • In the event of necessary street maintenance that conflicts with the parklet (e.g., street <br /> paving), the City may ask the applicant to remove the parklet. <br /> Trees <br /> Annual tree pruning of street trees downtown is essential to avoid excessive limb failure (which <br /> is a safety concern) and to monitor the health of City trees. This pruning takes about three <br /> weeks annually with more time required if removals are necessary. During the annual tree <br /> care, parklets will need to be left unoccupied by people and furniture to avoid any potential risk <br /> of injuries or damage. Staff suggests the following parameters be incorporated into the <br /> Agreement: <br /> • Annually, parklet structures will need to be vacated for one month. Staff suggests the <br /> parklet structures can remain on the street, but they will need to be clear of both <br /> furniture and people in order to perform the necessary tree pruning. The specific month <br /> can be predetermined with the Operations Services Department and included in the <br /> Parklet Agreement so that parklet operators have advanced notice. <br /> Permit Process <br /> Approval to install a parklet would occur through issuance of a Parklet Permit by the Planning <br /> Division. Applicants would submit an application to the Planning Division for review and <br /> approval, similar to the City's existing Outdoor Dining Permit (for sidewalk dining).' <br /> The Outdoor Dining permit is similar to the proposed Parklet Program, in that it allows businesses to place tables, umbrellas <br /> etc. in the right-of-way on the sidewalk if basic performance standards are met(e.g., maintenance, demonstration of liability <br /> coverage,hours of operation,etc.). <br /> Parklets Planning Commission <br /> 8 of 12 <br />
