ATTACHMENT #1 <br /> ORDINANCE NO. <br /> AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON AMENDING PLEASANTON MUNICIPAL CODE CHAPTER 9.30 <br /> WATER MANAGEMENT PLAN TO ADJUST IRRIGATION RESTRICTIONS <br /> AND OTHER MINOR AMENDMENTS <br /> WHEREAS, the City is currently under a declaration of Local Drought Emergency <br /> with a Stage 2 water shortage at 15 % mandatory conservation; and <br /> WHEREAS, closer alignment of allowable irrigation frequency with Dublin San <br /> Ramon Services District will help to reduce customer confusion over watering restrictions <br /> while maintaining seasonal best watering management practices for plant health over <br /> periods of water shortage; and <br /> WHEREAS, the City seeks to address the specialized water reduction limitation of <br /> life and safety services by defining medical patient-care facilities and setting a reduced <br /> reduction threshold when 20 % or higher mandatory water restrictions are declared. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. The City Council finds and declares that there is a current and <br /> immediate threat to the public health, safety and welfare due to exceptional drought <br /> conditions, and this urgency ordinance must be adopted as an urgency matter necessary <br /> for the immediate preservation of the public health, safety and welfare. <br /> Section 2. Amends Pleasanton Municipal Code Chapter 9.30 Water Management <br /> Plan as set forth in the attached Exhibit A. <br /> Section 3. A summary of this ordinance shall be published once within <br /> fifteen (15) days after its adoption in "The Valley Times," a newspaper of general <br /> circulation published in the City of Pleasanton, and the complete ordinance shall be <br /> posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br /> adoption. <br /> Section 4. This ordinance shall take effect immediately pursuant to California <br /> Government Code §36937(b). <br /> Section 5. The adoption of this urgency ordinance is exempt from the California <br /> Environmental Quality Act ("CEQA") pursuant to California Public Resources Code <br /> §21080(b)(4) because adoption of this urgency ordinance it to mitigate an emergency. <br /> The foregoing urgency Ordinance was adopted at a regular meeting of the City <br /> Council of the City of Pleasanton on December 21, 2021 by the following vote: <br /> Ayes: <br />
