ORDINANCE NO. 2228 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING CHAPTERS 18.32, 18.84, 18.88, AND 19.16 AND CREATING CHAPTER <br /> 18.101 OF THE PLEASANTON MUNICIPAL CODE TO IMPLEMENT SENATE BILL 9 <br /> REGARDING TWO-UNIT HOUSING DEVELOPMENTS AND URBAN LOT SPLITS IN <br /> SINGLE-FAMILY RESIDENTIAL ZONES <br /> WHEREAS, on September 16, 2021, Senate Bill 9 amended Section 66452.6 of the <br /> Government Code and added Government Code Sections 65852.21 and 66411.7, changing the <br /> requirements for additional housing units on properties within a single-family zone and for parcel <br /> map approval of an urban lot split; and <br /> WHEREAS, the changes to Government Code by Senate Bill 9 are effective January 1, <br /> 2022; and <br /> WHEREAS, State law provides that a local agency may adopt an ordinance that provides <br /> ministerial approval for: (1) no more than two residential units on a lot within a single-family <br /> residential zone, and (2) for an urban lot split; and <br /> WHEREAS, State law also provides that a local agency may require these applications <br /> to meet objective standards; and <br /> WHEREAS, the proposed amendments to the Pleasanton Municipal Code implement the <br /> requirements of state law and add local policies that are within the scope of the state law; and <br /> WHEREAS, on October 27, 2021, the Planning Commission held a duly-noticed public <br /> hearing and considered relevant exhibits, recommendations of the City staff, received testimony <br /> from the public, and provided a favorable recommendation with changes to staff's <br /> recommendation, regarding the proposed amendments to the Pleasanton Municipal Code; and <br /> WHEREAS, the proposed code amendments are to implement Senate Bill 9 and are not <br /> considered a project under Division 13 (commencing with Section 21000) of the Public Resources <br /> Code and are categorically exempt per CEQA Guidelines Section 15303. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves Case P21-1015, Amendments to Chapters 18.32, 18.84, 18.88, <br /> and 19.16 and creation of new Chapter 18.101 of the Pleasanton Municipal Code regarding two- <br /> unit housing developments and urban lot splits in single-family residential zones, as shown in <br /> Exhibit A to this ordinance. <br /> SECTION 2. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in the <br /> City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City <br /> Clerk's office within fifteen (15) days after its adoption. <br /> SECTION 3. This ordinance shall be effective thirty (30) days after its passage and <br /> adoption. <br />
