Resolution No. 04-045 <br />Page 2 <br /> <br />Section 4: <br /> <br />No materials other than the voter's pamphlet and sample ballot shall be <br />transmitted by the City Clerk to the voters; ifa candidate wishes to send additional <br />materials to the voters, it will be at the candidate's expense and by persons other <br />than the city. <br /> <br />Section 5: <br /> <br />In case of a tie vote at the November 2, 2004 election, a special nm-off election is <br />ordered, as follows: <br /> <br />The special election must be held on a Tuesday, not less than 40 days nor more <br />than 125 days after the certification of the election which resulted in the tie vote. <br />Ifa regular election is to be held during this time period, the special mn-off <br />election will be consolidated with the regular election. <br /> <br />Section 6: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON JUNE 15, 2004 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers-Ayala, Brozosky, Campbell, Hosterman, and <br />Mayor Pico <br />None <br />None <br />None <br /> <br />ATTEST: /~ <br /> <br />Da/an G.
