CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, ALAMEDA RESOLUTION NO. 04-043 A RESOLUTION FINDING THAT CERTAIN FUNDS COLLECTED FROM DEVELOPERS ARE UNEXPENDED AFTER FIVE YEARS BUT THAT THE FUNDS ARE COMMITTED TO PARTICULAR PROJECTS WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, Government Code 66001(d), effective January 1, 1989, requires the City (a) to make findings once each fiscal year with respect to any portion of a fee remaining unexpended in its account five or more years after deposit of the fee, (b) to identify the purpose to which the fee is to be put and to demonstrate a reasonable relationship between the fee and the purpose for which it is charged, (c) to identify all sources and amounts of funding anticipated to complete financing and (d) to designate the approximate date the expected funding will be deposited; and staff has reviewed the development fees collected between July 1, 1997 and June 30, 1998 to determine if any such development fees remain unexpended; and staff has found that there are three development impact fees collected from developers for this period that remain unexpended; and the City is committed to use two of the fees to reimburse certain parties for the construction of capital improvements for which these fees have been collected and the City is committed to use one fee for construction of a capital improvement if and when certain issues are resolved; and staff has reviewed the development fees collected between July 1, 1992 and June 30, 1993 that received findings five years ago to determine if any such development fees still remain unexpended; and staff has found that there are three development impact fees collected from developers for this period that received findings five years ago and remain unexpended; and the City is committed Io construct capital improvements for which two of these fees have been collected and is waiting to disburse the other fee to Kaiser Permanente; and
