Mr. Matt Gruber Subject: Augustin Bernal Mountain Bike Trail Additional Services Project Implementation Support Services TASK 8: STORMWATER POLLUTION PREVENTION PLAN Dudek will perform an evaluation of the applicability of waiver criteria and requirements to determine the need for the City to obtain coverage under the Construction General Permit(CGP). Dudek will review the proposed project activities, impact acreages, and construction timeline to determine if the project qualifies for the Environmental Protection Agency's Low Erosivity Waiver(LEW).This waiver may be granted by Regional Water Quality Control Board (RWQCB )if the total rainfall erosivity factor is less than 5.0. Based on the results of the waiver analysis, Dudek will provide a recommendation to the City regarding applicability of the LEW. If Dudek determines the waiver is applicable, we will submit a waiver application using the Water Board's SMARTS system on the City's behalf.This will require the City to designate Dudek's Qualified Stormwater Developer(QSD) as a data entry person on their SMARTS account. Alternately, Dudek can provide support for City staff to prepare and submit the waiver application, if desired. If Dudek determines the LEW is not an applicable waiver, we will provide a memorandum documenting the rationale, and prepare and file a Notice of Intent(N01)to RWQCB for coverage under the CGP.The N01 will include an SWPPP as part of the submittal, which Dudek's QSD will develop as part of this task. Assumptions • The City will be responsible for any application processing fees associated with the LEW or SWPPP; • SWPPP implementation services (monitoring,testing, and reporting), if needed, would be performed under a separate contract or a contract augmentation; • If coverage under the CGP is required,the Project would be considered a Risk Level 1 or 2 SWPPP project; • It is assumed that there will be two electronic submittals of each deliverable:an initial draft and a final submittal to address any comments; Deliverables • Waiver justification for submittal to RWQCB or memorandum documenting reasoning that the Project does not qualify for a waiver; and • Draft and final N01 for submittal to RWQCB, including a SWPPP, if waiver not applicable. TASK 9: CONSTRUCTION SUPPORT BIOLOGICAL SURVEYING AND MONITORING Task 9 costs will be determined once the design is complete and the project is bid. Dudek will provide biological survey and monitoring services before and during the construction phase of the project. Specifically, Dudek will assist the City with implementing expected biological resource protection measures to be incorporated into the project description.
