The SRO will operate under the philosophy of Community Oriented Policing and <br />problem solving on school campuses and surrounding neighborhoods. <br />The SRO will, when appropriate, engage in de-escalation tactics to resolve conflict. <br />De- escalation is the process of using strategies and techniques intended to decrease the <br />intensity of asituation including, but not limited to verbal and non-verbal <br />communication techniques and, when possible, using non -confrontational practices <br />to gain control. <br />The SRO, when possible, will make the physical arrest of students outside the presence of <br />other non-involved students. The objective is to preserve the privacy of juveniles. <br />The SRO will normally wear a Police Department approved uniform; however, the SRO <br />may wear other appropriate clothing depending upon the activity in which the SRO is <br />engaged. A Police Department approved uniform includes the traditional uniform or a <br />polo shirt and 5.11 style khaki pants worn at the discretion of the SRO and their <br />supervisor. Representatives of the Youth and Community Services Unit and PUSD <br />designee(s) will explore the feasibility of alternative uniform options during the 2021-22 <br />school year. <br />MUTUAL COOPERATION <br />A. CITY'S Cooperation: CITY shall provide PUSD will all pertinent data, <br />documents and other requested information as is reasonably available for the <br />district's proper performance of the services required under this agreement. <br />B. PUSD's Cooperation: PUSD shall provide the CITY with all the pertinent data, <br />documents, and other requested information as is reasonably available for the <br />CITY's proper performance of the services required under this agreement. This <br />includes student and personnel records related to criminal investigations. <br />Additionally, PUSD will allow the CITY to proceed with criminal investigation <br />before any administrative investigation or action is taken. <br />ATTORNEY'S FEES <br />In any litigation or other proceeding by which one party seeks to enforce its rights under <br />this Agreement (whether in contract, tort or both) or seeks a declaration of any rights or <br />obligations under this Agreement, the prevailing party shall be awarded reasonable <br />attorney's fees together with any costs or expenses, to resolve the dispute and to enforce <br />the final judgement. <br />DISPUTE RESOLUTION <br />If a dispute arises out of or relates to this contract, or the breach thereof, and if the dispute <br />cannot be settled through negotiation, and if either parry chooses not to terminate this <br />contract, the parties agree first to try in good faith to settle the dispute by mediation <br />before resorting to arbitration, litigation, or some other dispute resolution procedure <br />before making a good faith attempt to mediate the dispute, that the parry waives its rights <br />to recover its costs and attorney's fees in that procedure, even if it is deemed the <br />Page 8 of 13 <br />
