(b) This Ordinance shall apply only within the boundaries of Member Agencies that have <br />adopted an ordinance declaring that the Member Agency is opting in to this Ordinance <br />and that it shall apply within their jurisdiction. For any Member Agency that opts in, this <br />Ordinance shall apply as to that Member Agency from the date specified in the <br />ordinance adopted by the Member Agency. A Member Agency that has adopted such an <br />ordinance may declare that this Ordinance no longer applies within its boundaries by <br />adopting a subsequent ordinance setting forth the date upon which this Ordinance shall <br />no longer apply. <br />SECTION 14. SEVERABILITY <br />If any provision of this Ordinance or the application thereof is for any reason held to be invalid or <br />unconstitutional by a decision of any court of competent jurisdiction, such invalidity shall not <br />affect the remaining provisions or application of the remaining provisions of this Ordinance, <br />which can be given effect without the invalid provisions or application. <br />SECTION 15. EFFECTIVE DATE AND REPEAL OF ORDINANCE 2012-1 <br />This Ordinance shall be posted at the WMA Office after its adoption by the Board for at least <br />thirty (30) days and shall take effect commencing on January 1, 2022. The WMA's Ordinance <br />2012-01 (An Ordinance Requiring Actions to Reduce Landfilling of Recyclable and Organic <br />Solid Wastes from Businesses, Multifamily Residences, and Self -Haulers) is repealed as of the <br />time that this Ordinance takes effect. <br />Following introduction on June 23, 2021, passed and adopted July 28, 2021 by the <br />following vote: <br />AYES: Arkin, Carling, Cavenaugh, Cox, Hannon, Hernandez, Jordan, Kalb, Kassan, <br />Lamnin, Martinez, Patino, Sadoff, Spencer, Wengraf, Young <br />NOES: None <br />ABSTAIN: None <br />ABSENT: Haubert <br />I certify that under the penalty of perjury that the foregoing is a full, true and correct copy <br />of Ordinance No. 2021-02. <br />ARLISS DUNN <br />CLERK OF THE BOARD <br />
