Ordinance No. 2226 <br />Page 3 of 39 <br />9.23.030 Local Amendments. <br />The city adopts the following local amendments to WMA Ord. 2021-02 as follows: <br />A. The Enforcement Agency for the provisions of Sections 5, 6, 8, 9, and 10, of the WMA <br />Ord. 2021-02 is the City, the WMA, and any other Designee of the City. The Enforcement <br />Agency for the provisions of Sections 7, 11 and 12 of the WMA Ord. 2021-02 is the City, <br />the WMA, the Alameda County Department of Environmental Health, and any other <br />Designee of the City and authorizes the City Manager to enter into agreements with WMA <br />and ACDEH. <br />B. WMA Ord. 2021-02 Section 4 is amended to exclude the phrase, "Except Single -Family <br />Organic Waste Generators that meet the Self -Hauler requirements in Section 10 of this <br />Ordinance. <br />C. WMA Ord. 2021-02 Section 6 subsection (c) is deleted; therefore "Collection Frequency <br />Waiver" for commercial business generators is not applicable in the city. <br />D. WMA Ord. 2021-02 Section 10 subsection (h) is deleted. <br />9.23.040 Severability. <br />The city declares that each section, sub -section, paragraph, sub -paragraph, sentence, <br />clause and phrase of this ordinance is severable and independent of every other section, sub- <br />section, paragraph, sub -paragraph, sentence, clause and phrase of this ordinance. If any section, <br />sub -section, paragraph, sub -paragraph, sentence, clause or phrase of this ordinance is held <br />invalid, the city declares that it would have adopted the remaining provisions of this ordinance <br />irrespective of the portion held invalid, and further declares its express intent that the remaining <br />portions of this ordinance should remain in effect after the invalid portion has been eliminated. <br />SECTION 3. Amends Municipal Code Chapter 9.20, changes the title of Chapter 9.22, <br />and amends Sections 20.26.020, 20.26.050 and 20.26.070 as set forth in Exhibit B to conform <br />with SB 1383 Regulations and the countywide Organics Reduction and Recycling Ordinance <br />2021-02 adopted by the Alameda County Waste Management Authority. <br />SECTION 4. A summary of this ordinance shall be published once within fifteen (15) <br />days after its adoption in "The Valley Times," a newspaper of general circulation published in the <br />City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City <br />Clerk's office within fifteen (15) days after its adoption. <br />SECTION 5. This ordinance shall take effect commencing on January 1, 2022. <br />
