SB 478 (Wiener) This bill prohibits a local agency, as defined, from imposing a floor <br />area ratio (FAR) standard that is less than 1.0 on a housing development project that <br />consists of 3 to 7 units, or FAR less than 1.25 on a housing development project that <br />consists of 8 to 10 units.3 The bill prohibits a local agency from imposing a lot coverage <br />requirement that would physically preclude a housing development project from <br />achieving the floor area ratios described above, and prohibits a local agency from <br />denying a housing development project located on an existing legal parcel solely on the <br />basis that the lot area of the proposed lot does not meet the local agency's <br />requirements for minimum lot size. The bill only applies to housing development <br />projects that meet specified requirements, including that the project be located in a <br />multifamily residential zone or a mixed-use zone. The minimum FARs required <br />significantly exceed those in City's existing Multi -Family Residential Zones, although are <br />not more than the FARs currently allowed in the existing mixed use zones. <br />Future Housing Legislation <br />New legislation that may come forward in the 2022 legislative session is likely to <br />include: <br />• COVID-19 Recovery <br />• Housing <br />• Climate related issues such as water, drought, energy <br />• Transportation <br />Staff will continue to work with Townsend Public Affairs to closely monitor State <br />legislative activity, and to submit letters and testimony on behalf of the City for all bills <br />on which the City Council has established a position. FAR is calculated by dividing the square <br />footage of a building, by the square footage of the parcel on which it is located.
