ATTACHMENT#2 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DECLARING A STAGE 2 WATER SHORTAGE AND MANDATING THAT <br /> PLEASANTON WATER CUSTOMERS REDUCE THEIR POTABLE WATER USAGE BY <br /> FIFTEEN PERCENT (15%) <br /> WHEREAS, the City of Pleasanton is located in an area of California for which the State <br /> has declared a regional drought state of emergency; and <br /> WHEREAS, water supply deliveries for the coming year are uncertain if they can meet <br /> projected demand as the City's water wholesaler, Zone 7 Water Agency, is projected to receive <br /> only 5% of its requested allotment through the State Water Project, and thereby Zone 7's Board <br /> declared a Stage 2 water shortage mandating a 15% water reduction; and <br /> WHEREAS. the City recently adopted the 2020 Urban Water Management Plan and <br /> Water Shortage Contingency Plan, including the introduction of an ordinance to amend Municipal <br /> Code Chapter 9.30 Water Management Plan on September 7, 2021, which set a series of stages <br /> and corresponding water use restrictions; and <br /> WHEREAS, to date, voluntary water reduction has not been sufficient to address the <br /> exceptional drought situation and the City now needs to mandate reduction in the use of potable <br /> water to maintain a sufficient water supply to ensure the protection of the public health, safety, <br /> and welfare. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Declares a Stage 2 water shortage pursuant to Municipal Code Chapter <br /> 9.30 and mandates that Pleasanton water customers reduce potable water usage by fifteen <br /> percent (15%). <br /> SECTION 2. Directs staff to base mandatory reductions on average usage from the <br /> same billing period from prior one to four years, as provided in Municipal Code §9.30.070. <br /> SECTION 3. Directs staff to take into consideration households which have already been <br /> conserving water when determining the application of penalties for failure to reduce usage by <br /> 15% by reviewing billing periods from the prior one to four years that might reflect lower volume <br /> usage through conservation. <br /> SECTION 4. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> SECTION 5. City Clerk shall certify to the passage of this resolution and enter it into the <br /> book of original resolutions. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on October 5. 2021. <br />
