35. SUBDIVISION IMPROVEMENT AGREEMENT. As indicated on Sheet 3 of the VTPM, the <br />Dennis Drive frontage must be fully developed including road widening and dedication of <br />public right-of-way and easement for public services. Said work shall be guaranteed by a <br />Subdivision Improvement Agreement drafted by the City Attorney with sufficient financial <br />security to assure completion of the required work by the subdivider. Project specific <br />condition. <br />36. EXCESS RIGHT-OF-WAY. According to Sheet 2 of the VTPM plans (Reference 3), a <br />triangular area of excess right-of-way will be created at the interface between Parcel 2 and <br />the adjoining Lot 12 of Tract 6596 (2508 Wilde Avenue, APN# 946-1146-13). As part of this <br />subdivision, the City would like to vacate this excess right-of-way such that a portion is <br />merged with Parcel 2 and a portion is merged with Lot 12. This area has been landscaped <br />presumably by the owner of Lot 12 (Jeffrey and Paige Finn). The applicant shall work <br />collaboratively with the Lot 12 owner and then propose an equitable split of the triangular <br />area between Parcel 2 and Lot 12, prior to approval of Parcel Map. Any irrigation system or <br />good neighbor fencing installed by the Lot 12 owner shall be modified as necessary as part <br />of this application. If the Lot 12 owner refuses to accept a portion of the triangular area, then <br />the entire area shall be merged with Parcel 2. Said vacation of public right-of-way shall follow <br />the regulatory procedures described in California Streets and Highways Code §8330 et seq. <br />Project specific condition. <br />37. MONUMENTS. The Parcel Map shall include two survey monuments (iron pipes with caps) <br />where the proposed property line between Parcel 1 and Parcel 2 meets the north and south <br />boundary lines. In accordance with §66495-66497 of the California Government Code, the <br />Parcel Map must include sufficient durable survey monuments to allow the subdivision to be <br />retraced. Project specific condition. <br />38. UNDERGROUND UTILITIES FOR NEW HOUSE. All new utilities to serve the proposed <br />house shall be installed underground. Project specific condition. <br />39. UTILITY UNDERGROUNDING ON MARTIN AVENUE. The existing overhead joint pole <br />utilities along the Martin Avenue frontage shall either be placed underground by the <br />applicant, or the applicant shall deposit funds with the City in an amount proportional to the <br />applicant's share of the total cost of a future City -sponsored undergrounding project. The <br />existing joint pole utilities extend on the west side of Martin Avenue from south of Trenery <br />Drive to the northern cul-de-sac bulb. The applicant's contribution will be $55,560. Project <br />specific condition. <br />40. RELOCATION OF EXISTING CITY STREET LIGHT. An existing City -maintained streetlight <br />exists at the outside bend of the road where Newton Way and Dennis Drive intersect. Said <br />existing streetlight shall be relocated at the applicant's cost according to City Standard Detail <br />502. In addition, the existing R26 "No Parking" sign mounted to the existing light post shall <br />be removed. Project specific condition. <br />41. STREET NAME SIGN. At the bend of the road where Newton Way and Dennis Drive <br />intersect, the applicant shall install a street name sign in accordance with City Standard <br />Details 117 and 118.
