ATTACHMENT 5
P21-0079 and PUD -140, Terry Townsend. 2207 Martin Avenue
Applications for: 1) Minor Subdivision approval to subdivide an approximately 1.67 -acre parcel
into two parcels measuring approximately 21,794 square feet (Parcel A) and approximately
48,311 square feet (Parcel B); and 2) Planned Unit Development (PUD) development plan
approval to retain the existing home and related improvements on Parcel B and construct a
two-story home and related site improvements on Parcel A. Zoning is PUD-LDR (Planned Unit
Development — Low Density Residential) District.
P21-0076 and PUD -141, Terry Townsend. 2215 Martin Avenue
Applications for: 1) Minor Subdivision approval to subdivide an approximately 1.67 -acre parcel
into two parcels measuring approximately 21,986 square feet (Parcel A) and approximately
49,951 square feet (Parcel B); and 2) Planned Unit Development (PUD) development plan
approval to retain the existing home and related improvements on Parcel B and construct a
two-story home and related site improvements on Parcel A. Zoning is PUD-LDR (Planned Unit
Development — Low Density Residential) District.
Commissioner Allen requested, for the public's benefit, that staff share the contents of the
memo sent to the Commission prior to the meeting related to the sidewalk concerns for Items
4 and 5.
Ms. Amos provided information regarding the staff memo previously distributed to the
Commission related to the sidewalk and current project conditions of approval, noting the
memo clarified the requirement for installation of sidewalks along the Dennis Drive frontage
and the two referenced applications. She confirmed the agenda reports for both projects
implied the City would be accepting funding in lieu of requiring the projects to complete
roadway widening and street installation, however, that was not reflected in the Conditions of
Approval (COAs) recommended before the Commission. She stated COA No. 35 for PUD -140
and COA No. 36 for PUD -141 referenced the subdivision improvement agreement where the
property owners or subdivider would need to enter into a subdivision improvement agreement
with the City to ensure the completion of the required work would be completed by the
subdivider. She further clarified that COA No. 86 for PUD -140 and COA No.87 for PUD -141
conditioned the project developer to install a five-foot sidewalk along the project frontage for
Dennis Drive. She further discussed the gap in the sidewalk in front of 3520 Dennis Drive,
noting City Council approval of an application in 2006 at 2001 Martin Drive which was similar
to the current applications for PUD -140 and PUD -141 to subdivide the lot and develop a
single-family residence in the front. She stated, at that time, City Council accepted funds in lieu
of the subdivider installing the sidewalk and widening Dennis Drive, however, that work had
not yet been included with any of the City's Capital Improvement Plan (CIP) Projects. She
stated, if installation of the sidewalk were to be constructed along the Dennis Drive frontage, it
would require City Council to take action for additional funding due to the increase of materials
and labor costs over the past 15 years, in addition to including the work within a future CIP
project to complete the gap in the sidewalk along that portion of Dennis Drive.
Ms. Amos presented the specifics of the item in the Agenda Report.
Commissioner Nibert noted he visited the site and noticed items similar to the written public
comments received, particularly comments from Mike and Margaret Quinn, and Steve Grau
and Jenny Grau, who expressed their concerns regarding completion of the sidewalk and
roadway widening along Dennis Drive. He agreed that the concern was related to safety,
Excerpt: Approved Planning Commission Minutes, July 14, 2021 Page 1 of 4
