• Language has been added to provide examples of evidence to lease the space,
to make the policy intent clearer (evidence such as copies of advertisements or
listings or time-stamped photographs of"for lease" signage), but as
recommended by the Planning Commission, the language has been written such
that the submittal of these materials is compulsory.
• The draft language makes clear that City Council would be notified of a decision
by the Director of Community Development, in addition to Planning Commission,
consistent with notification requirements for other administrative decisions.
These draft changes are to be incorporated as draft changes shown for PMC Section
18.81.050.
Procedures for Obtaining Zoning Certificate Approval - New Text Proposed in PMC
A new section to PMC Chapter 18.81 is proposed, outlining the procedure for obtaining
a zoning certificate for a use subject to the overlay.
The proposed text in Chapter 18.81.040 indicates that the Director of Community
Development may, in response to an application for zoning certificate for any business
that is subject to the overlay, request additional information to verify compliance with the
provisions of the policy and code. The additional information that is required could
entail a written narrative that identifies the proposed operation of the use, including
confirmation of a point-of-sale system and proposed business hours and a dimensioned
floor plan that identifies the leased square footage for each use, along with a copy of the
lease agreement. The draft text in the PMC also indicates that the Director may request
that the applicant provide other information in support of the application, if deemed
necessary to demonstrate conformance with the policy and provisions of the code.
GENERAL PLAN CONFORMITY
The City's General Plan includes the following policies that support the proposed
amendments to the DSP and PMC:
Economic and Fiscal Element Focus City efforts on supporting and assisting
Policy 5 Pleasanton businesses success.
Economic and Fiscal Element Work in cooperation with the Pleasanton Downtown
Program 6.1 Association, Chamber of Commerce, and other
business organizations.
Economic and Fiscal Element Maintain a diverse and stable revenue system.
Goal 4
Economic and Fiscal Element Promote a varied mix of land uses to ensure a broad
Program 8.1 revenue base through proactive land use planning
and zoning.
