Ms. Hagen displayed a visual and highlighted the property line, showing the dense tree covering that encompassed the creek corridor and distance from the anticipated parking lot. She stated the concern about the possibility of lights from vehicles shining into the Otto's property and indicated the Otto's had requested additional screening. Commissioner Allen inquired about heritage trees being removed, especially on Dublin Canyon Road and the mitigation value to be paid by the developer. Ms. Hagen stated the arborist report showed the dollar value for the trees and referenced the condition requiring the developer to pay the value of the trees. Commissioner Gaidos questioned the proposed tree plantings. Ms. Hagen confirmed the plans to plant along the western edge. Commissioner Gaidos thanked the applicant for the revisions made, including the meandering sidewalk. Commissioner Nibert asked about use of the kitchen for church events. He inquired if Open Heart Kitchen (or similar community groups) would be allowed to use the kitchen. Ms. Clark stated that the church might elect to enter into an agreement for such use; staff would evaluate whether it was allowable based on the scale and nature of the use. Commissioner Pace inquired how use by charitable services would be determined. Ms. Hagen stated open communication between the church and the City would be utilized to determine use and overall impacts. She discussed commercial kitchens in other churches in the City. She discussed use for charitable events or non-profit businesses. Commissioner Pace stated he wanted to ensure the church had the opportunity to use the kitchen for the benefit of the community. He inquired about squirrel nesting and construction protocols. Ms. Hagen referenced codes and best management practices to help potential issues, although it was difficult to control the movements of wild animals. She noted that staff typically worked closely with the construction team to ensure issues were addressed immediately if they came up. Commissioner Morgan asked about the 350-attendee trigger for requiring special event approval; parking overflow; use of well or City water; and tree removal. Ms. Hagen discussed the 350-person number, which was chosen since it was above the largest projected congregation size, and parking requirements and use for larger events. She discussed the option to use of well water for landscaping. She presented a visual of the proposed tree removal due to conflict with the driveway and utility infrastructure and poor health. She discussed the undergrounding of utilities between the parking lot and right-of-way. THE PUBLIC HEARING WAS OPENED Applicant Tim Sbranti thanked staff and the community for their support. He provided a brief introduction to the project. Architect Michael Goldsworthy provided comment and highlighted some of the modifications made based on comments from the Commission during the April 14, 2021 Work Session. Father Niko Bekris expressed gratitude for the opportunity and thanked the Commission.
