RESOLUTION NO. 21-1232 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AUTHORIZING THE MAYOR TO EXECUTE TWO RIGHT-OF-WAY CONTRACTS AND <br /> GRANT TWO TEMPORARY CONSTRUCTION EASEMENTS TO THE ALAMEDA <br /> COUNTY TRANSPORTATION COMMISSION FOR THE 1-680 SOUTHBOUND <br /> EXPRESS LANES BETWEEN STATE ROUTE 84 AND ALCOSTA BOULEVARD <br /> PROJECT <br /> WHEREAS,the Alameda County Transportation Commission (ACTC) is the Implementing <br /> Agency for the 1-680 Southbound Express Lane Between State Route 84 and Alcosta Boulevard <br /> (the "Project"); and <br /> WHEREAS, in order to construct the project ACTC is requesting that the city grant ACTC <br /> approximately 15-foot wide Temporary Construction Easements (TCEs) along the edge of two <br /> city-owned properties adjacent to the 1-680; and <br /> WHEREAS, the two city-owned properties have Alameda County Assessor Parcel <br /> Numbers 941-1000-5 and 946-4590-8-2; and <br /> WHEREAS, the two city properties are vacant open space lands adjacent to freeway with <br /> no plans for any type of development; and <br /> WHEREAS, ACTC has offered a payment totaling $11,300 for the 40 months the <br /> Temporary Construction Easements are required; and <br /> WHEREAS, ACTC has prepared a Right-of-Way Contract for each Temporary <br /> Construction Easement requested; and <br /> WHEREAS, ACTC has prepared a Grant Deed for each Temporary Construction <br /> Easement requested. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Authorizes the Mayor to execute Right-of-Way Contract with ACTC for <br /> each TCE requested, subject to minor modifications by the City Manager as approved by the City <br /> Attorney. <br /> SECTION 2. Authorizes the Mayor to grant the two TCEs to ACTC, subject to minor <br /> modifications by the City Manager as approved by the City Attorney, as well as other necessary <br /> related documents. <br /> SECTION 3. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> SECTION 4. City Clerk shall certify to the passage of this resolution and enter it into the <br /> book of original resolutions. <br />
