PC-2021-13 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br /> PLEASANTON RECOMMENDING TO THE CITY COUNCIL APPROVAL OF <br /> AMENDMENTS TO THE DOWNTOWN SPECIFIC PLAN AND TO CHAPTERS 18.08 <br /> AND 18.81 OF THE PLEASANTON MUNICIPAL CODE REGARDING THE ACTIVE <br /> GROUND FLOOR USE OVERLAY [CASES P21-0636 AND P21-0637] <br /> WHEREAS, on August 20, 2019, City Council voted to adopt a revised <br /> Downtown Specific Plan and associated amendments to the Pleasanton Municipal <br /> Code, inclusive of establishing the Active Ground Floor Use Overlay in downtown <br /> Pleasanton; and <br /> WHEREAS, on March 2, 2021, upon recommendation from the Planning <br /> Commission, City Council directed staff to schedule the Active Ground Floor Use <br /> Overlay for discussion by City Council; and <br /> WHEREAS, on June 1, 2021, City Council discussed the Active Ground Floor <br /> Use Overlay and directed staff to: (1) modify the Downtown Specific Plan and <br /> Pleasanton Municipal Code regarding the overlay such that an increased proportion of a <br /> multi-use tenant space be dedicated to active uses; (2) draft related clarifying language <br /> as it relates to the overlay; and (3) solicit feedback from key stakeholders including the <br /> Pleasanton Downtown Association and the Chamber of Commerce regarding the <br /> possible amendments; and <br /> WHEREAS, on July 13, 2021 and July 14, 2021, staff presented potential <br /> changes to policies in the Downtown Specific Plan and the Pleasanton Municipal Code <br /> to the Pleasanton Downtown Association and the Chamber of Commerce, respectively; <br /> and <br /> WHEREAS, the proposed amendments are exempt from the California <br /> Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3). <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City <br /> of Pleasanton, based on the entire record of proceedings, including the oral and written <br /> staff reports and all public comment and testimony: <br /> Section 1: The Planning Commission hereby recommends to the City Council approval <br /> of Cases P21-0636 and P21-0637, Amendments to the Downtown Specific Plan and <br /> Chapters 18.08 and 18.81 of the Pleasanton Municipal Code regarding the Active <br /> Ground Floor Use Overlay, as shown in Attachment 1 and 2 to this resolution. <br />. The additional information <br /> that is required could entail a written narrative that identifies the proposed operation of <br /> the use, including confirmation of a point-of-sale system and proposed business hours. <br /> 3 This change is proposed to address the relatively common occurrence where a tenant will stop paying rent or <br /> discontinue its public-facing business operation, followed by a period during which it needs time to liquidate <br /> merchandise or clear fixtures from a space; during such a period it could be argued that the space is not <br /> technically "vacant." <br /> Active Ground Floor Use Overlay Planning Commission <br /> 4 of 5 <br /> of the tenant <br /> space be dedicated to the active use. <br /> 2 Staff's recommendation is for 60% of the depth and 60% of the square footage, although a variety of other <br /> options also exist, such as 50% or 75%. <br /> Active Ground Floor Use Overlay Planning Commission <br /> 3 of 5 <br /> for a <br /> vacant tenant space at 560 Main Street.
