(E) A jurisdiction implements or enforces an ordinance, policy, procedure, <br /> condition, or initiative that is prohibited. <br /> (F) A jurisdiction fails to submit the reports required. <br /> DISCUSSION <br /> SB 1383 requires jurisdictions to address and adequately resource seven areas as <br /> required by the regulations. City staff along with consulting firm HF&H have prepared a <br /> DRAFT SB 1383 Action Plan which outlines actions and cost estimates of implementing <br /> the programs and activities required and provide recommendations for how to <br /> implement the law. The seven areas areas are as follows: <br /> 1. Provide organic waste collection services to all residents and businesses. Organic <br /> waste is defined in the regulations to include green waste, wood waste, food waste, <br /> manure, and fibers. Collection containers must have prescribed colors (any shade of <br /> grey or black for trash, green for organic waste and blue containers for traditional <br /> recyclables) and container must be labeled as required by the regulations. There are <br /> additional provisions to monitor contamination in the waste stream during the collection <br /> process. <br /> The City has an established Organic waste program for both residential and commercial <br /> customers however participation in the program will now be mandatory under the <br /> requirements of SB 1383. Currently, when a residential customers subscribes to service <br /> they select the size of the solid waste cart and automatically receive a 96-gallon mixed <br /> recycling cart (blue lid) and organics cart (green lid). Any residential customer who <br /> currently does not have a mixed recycling and/or organics cart will be issued one and <br /> will be required to properly sort their garbage and materials into the appropriate carts. <br /> Currently commercial customers are required to have a solid waste and mixed <br /> recycling. Under SB 1383 all commercial customers will also be required to subscribe to <br /> organics service. All commercial customers will be required to subscribe to solid waste, <br /> mixed recycling and organics service. <br /> 2. Monitor compliance and conduct enforcement. Monitoring and education must begin <br /> in 2022 and enforcement actions must start Jan 1, 2024. The City will be required to <br /> adopt ordinances and/or other enforceable policies and procedures as well as develop a <br /> monitoring and enforcement program. <br /> The monitoring program is comprised of several required activities: <br /> • Conduct contamination monitoring through garbage pickup route reviews <br /> annually and notify generators if contamination is found. <br /> • Conduct compliance desktop review of all commercial solid waste account and <br /> all multi-family account to ensure subscription to mixed recycling and organics <br /> service annually. <br /> Page 5 of 9 <br />
