<br /> <br />DRAFT – June 15, 2021 | Page 21 <br />THE CITY OF PLEASANTON <br />SB 1383 ACTION PLAN <br />2021 ─ 2025 <br />3.2 Monitoring and Enforcement <br /> <br />3.2 Monitoring and Enforcement <br /> <br />3.2.1 Program Summary <br />By January 1, 2022, jurisdictions must adopt ordinances and/or other enforceable policies and procedures, as well <br />as develop a monitoring and enforcement program. The City’s enforcement obligations will need to be <br />significantly expanded to include verification of SB 1383 compliance by generators, self-haulers (including back- <br />haulers), franchise haulers, construction and demolition debris haulers, commercial edible food generators, food <br />recovery organizations and services, and other entities. To establish a fully-compliant and comprehensive <br />enforcement program, the City will need to amend its existing ordinances, policies, and procedures. Between <br />January 1, 2022 and December 31, 2023, the City must provide education to non-compliant entities. The <br />enforcement program will include issuance of NOVs, and assessment of penalties for non-compliant regulated <br />entities. These provisions shall be actively enforced no later than January 1, 2024. <br />The goal of the monitoring and enforcement programs will be to ensure that each residential and commercial <br />generator subscribe to recyclables and organics collection services or similarly comply through self-hauling <br />requirements. The City may grant exceptions for commercial entities and multi-family dwellings that have been <br />granted waivers for conditions such as generation of de minimis volumes of material or physical space limitations. <br />While three-container collection service is currently available, not all generators are receiving organic materials <br />and recyclables collection service, as shown in Section 3.1.1, Figure 12. Most early enforcement efforts will be <br />focused on ensuring single-family, multi-family, and commercial customers subscribe to service. <br />The monitoring program is comprised of several activities required by SB 1383. The City must ensure that a <br />desktop review is conducted of all commercial solid waste accounts generating two cubic yards of solid waste or <br />more and all multi-family garbage accounts with five or more units. By imposing mandatory service of all three <br />waste streams and providing the appropriate containers to all generators, the City will minimize the effort <br />required to complete desktop compliance reviews. The monitoring regulations also mandate additional <br />inspection of certain regulated entities, route reviews or waste evaluations, and monitoring for container <br />contaminants for all generators. <br />The SB 1383 enforcement program requires distribution of educational materials, and issuance of NOVs and <br />penalties to non-compliant entities (see Section 3.2.2 below for further details on requirements).
