AGREEMENT FOR INSTALLATION AND MAIi,;TENANCE <br /> <br />OF LANDSCAPING <br /> <br />19 84 <br /> <br />THIS AGREEMENT is made this 13th day of <br /> <br /> , between Roy E. & Darlene I. Howe <br /> <br />hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, <br />a municipal corporation, hereafter referred to as "City". <br /> <br /> RECITALS <br /> <br /> THIS AGREEMENT IS BASED UPON THE FOLLOWING FACTS: <br /> <br /> (1) Property owner is the owner of meal property in the City of <br />Pleasanton described 645 Abbie Street, Pleasanton and made a pq~t <br />of it by this reference; <br /> <br /> (2) On September 14 , 19 83 , the City granted a Board of <br /> Adjustment variance approval to said property; <br /> (3) By the terms of the Board of Adjustment approval, property <br />owner is required to install and maintain landscaping in accordance <br /> <br />with a plan, to be approved by the Planning Department prior to Build- <br /> <br />ing Permit approval; <br /> <br /> (4) Both parties recognize that the installation and maintenance <br />of landscaping is an integral part of the property owner's plan for <br />development of the property. <br /> <br />MOW, THEREFORE, IT IS AGREED BET~EEH THE PARTIES, as follows: <br />1. Purpose~ The purpose of this Agreement is to assure (a) <br />installation in accordance with the landscaping plan previously <br />approved by the City and (b) continued maintenance and care of the <br />landscaping. <br /> <br /> <br />
