1.3 Special Maintenance Requirements. The <br /> <br />Association acknowledges that the City has permitted the <br />installation of Poplar trees within the Common Area <br />Easements (see Section 1.1.2) located at the intersection of <br />Hopyard Road and Stoneridge Drive and at the intersection of <br />Hacienda Drive and Stoneridge Drive. In the event that the <br />root systems of said Poplar trees cause any damage to, or <br />create any unreasonable maintenance problems for, any side- <br />walks, water lines, sewer lines, or other underground <br />utilities the Association shall within ten (10) days after <br />written notice from the City, at the Association's sole <br />expense, remove any and all of said Poplar trees which have <br />caused such damage or created such maintenance problem, <br />repair or replace as necessary any damaged sidewalks, water <br />lines, sewer lines or other underground utilities, and <br />replace the Poplar trees removed with street trees approved <br />by the City. <br /> <br /> 1.4 Term of Maintenance Obligations. Except as <br />provided below, the Association's obligations under Section <br />1.2 with respect to the areas described in Sections 1.1.1 <br />through 1.1.6, inclusive, shall commence upon the later of <br />(i) the date of this agreement, or (ii) the date upon which <br />the City Council of the City accepts ownership of the street <br /> <br />improvements and/or other public improvements under con- <br />struction in those areas and shall continue throughout the <br />term of this agreement, unless terminated as provided in <br />Section 6.3.
