Environmental Checklist and City of Pleasanton–10x Genomics Project <br />Environmental Evaluation Initial Study/Mitigated Negative Declaration <br /> <br /> <br />54 FirstCarbon Solutions <br />Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480024/ISMND/wp/21480024 10x Genomics Project Full Screencheck ISMND.docx <br />Mitigation Measures <br />MM BIO-1 Migratory Birds <br />• To prevent impacts to Migratory Bird Treaty Act (MBTA ) and/or Fish and Game <br />Code-protected birds, nesting raptors, and their nests, removal of trees shall be <br />limited to only those necessary to construct the proposed project. <br />• If any tree removal is necessary, then it should occur outside the nesting season <br />between September 1 through January 31. If trees cannot be removed outside the <br />nesting season, preconstruction surveys shall be conducted no more than 7 days <br />prior to tree removal to verify the absence of active nests. <br />• If an active nest is located during pre-construction surveys, construction activities <br />shall be restricted as necessary to avoid disturbance of the nest until its young has <br />fledged or the agencies deem disturbance potential to be minimal. Restrictions <br />may include establishment of exclusion zones (no ingress of personnel or <br />equipment at a minimum radius of 100 feet around an active nest depending on <br />the species) or alteration of the construction schedule. <br />• A qualified Biologist shall delineate the buffer using Environmentally Sensitive <br />Area fencing, pin flags, and or yellow caution tape. The buffer zone shall be <br />maintained around the active nest site(s) until the young have fledged and are <br />foraging independently. <br /> <br />MM BIO-2 Tree Preservation Guidelines <br />The following requirements would reduce impacts to trees from development and <br />maintain and improve their health and vitality through the clearing, grading and <br />construction phases. <br />1. All plans affecting trees shall be reviewed by the Consulting Arborist with regard <br />to tree impacts. These include, but are not limited to, grading, drainage and <br />utility plans, and landscape and irrigation plans. <br />2. A Tree Protection Zone shall be established around each tree to be preserved. <br />Tree Protection Zones are described in the Tree Protection Plan (provided under <br />separate cover). No grading, excavation, construction or storage of materials <br />shall occur within that zone. <br />3. Underground services including utilities, sub-drains, water or sewer shall be <br />routed around the Tree Protection Zone. Where encroachment cannot be <br />avoided, special construction techniques such as hand digging or tunneling <br />under roots shall be employed where necessary to minimize root injury. <br />4. Tree Preservation Notes, prepared by the Consulting Arborist, should be <br />included on all relevant plans. <br />5. Any herbicides placed under paving materials must be safe for use around trees <br />and labeled for that use. <br />6. Irrigation systems must be designed so that no trenching will occur within the <br />Tree Protection Zones.
