AGREEMENT FOR INSTALLATION AND MAINTENANCE <br /> <br />OF LANDSCAPING <br /> <br />THIS AGREEMENT is made this <br /> <br />4th day of August 1980 <br /> <br />between Frumenti Development Corporation <br /> <br />hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, <br />a municipal corporation, hereafter referred to as "City". <br /> <br /> RECITALS <br /> <br />THIS AGREEMENT IS BASED UPON THE FOLLOWING FACTS: <br />(1) Property owner is the owner of real property <br /> <br />in the City of <br /> <br />Pleasanton described in Exhibit "A", attached to this Agreement and <br />made a part of it by this referen'ce; <br /> <br /> (2) On December 11 , 19 79 , the City granted a <br /> <br /> Planned Unit Development approval to said property; <br /> <br /> (3) By the terms of the Planned Unit Development approval, property <br />owner is required to install and maintain landscaping in accordance <br />with a plan, to be approved by the Planning Department prior to Build- <br />ing Permit approval; <br /> <br /> (4) Both parties recognize that the installation and maintenance <br />of landscaping is an integral part of the property owner's plan for <br />development of the property. <br /> <br />NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES, as follows: <br />1. Purpose. The purpose of this Agreement is to assure (a) <br />installation in accordance with the landscaping plan previously <br />approved by the City and (b) continued maintenance and care of the <br />landscaping. <br /> <br /> <br />
