EXHIBIT A <br /> Scope of Consultant's Services <br /> I. ICS BASIC SERVICES <br /> The services as described shall be performed in all material respects in accordance with <br /> applicable laws, rules, regulations and standards of governmental authorities including, in <br /> particular, applicable Workers' Compensation Laws of the State of California. The following <br /> more fully details those services: <br /> A. Staffing Adequacy and Performance—Innovative Claim Solutions' ("ICS") <br /> policy is to assure that adequate staff is maintained to adjudicate claims in a timely and <br /> efficient manner. <br /> B. Coordination - ICS shall consult and coordinate with the City of Pleasanton's <br /> ("CLIENT'S") staff, or its designated contact, charged with responsibility for workers' <br /> compensation matters. ICS shall be responsible for keeping such staff, or its designated <br /> contact, informed of changes in the laws and regulations affecting the CLIENT'S <br /> responsibilities under its self-insured workers' compensation program. <br /> C. Claims Administration - ICS shall administer on behalf of the CLIENT all <br /> claims for workers' compensation in all material respects pursuant to all applicable laws, <br /> regulations and rules. On behalf of CLIENT, ICS shall perform the following services in <br /> connection with CLIENT'S Workers' Compensation Program: <br /> 1. Review and process reported claims for workers' compensation benefits <br /> that have not been closed as of the Effective Date of this Agreement and closed <br /> claims that reopen on or after the Effective Date. <br /> 2. Determine liability for claimed injuries and illnesses in accordance with <br /> California Workers' Compensation Laws. <br /> 3. Review and process all claims in accordance with rules and regulations <br /> established by the Division of Industrial Relations, Department of Self-Insurance <br /> Plans, and in accordance with the CLIENT'S policies. <br /> 4. Establish files containing medical and factual information on each <br /> reported claim together with complete accounting records and maintain same in <br /> accordance with statutory time requirements. <br /> 5. Make all workers compensation disability payments, and send all notices, <br /> in a timely and accurate manner and in conformance with all applicable <br /> provisions of the California Labor Code laws, rules and regulations. <br /> Wage <br />
