sewer capacity shall be charged at the rates in place as of the date of issuance of the building <br /> permits. <br /> Section 3.05 Water Meter Fee. The Property is currently served by the potable water meters as <br /> set forth in Exhibit D. The Developer is entitled to use any or all of these meters to service Phase <br /> 1 development as well as subsequent phases provided the utility billing for each account remains <br /> non-delinquent. Unused water meters shall be permanently decommissioned by removal of the <br /> meter by City staff,removal of the service lateral to the main by the Developer in accordance with <br /> City Standard Specification 14-03I "Abandonment of Water Facilities", and termination of utility <br /> billing by the Developer. If any existing water meter will be changed to a different size to <br /> accommodate Phase 1 development or subsequent phases, the Developer will be entitled to a fee <br /> credit for both the City Connection Fee and the Zone 7 Connection Fee in effect at the time of <br /> payment,not application date, for the replaced meter. The Developer shall then be required to pay <br /> the current Meter Fee,the City Connection Fee, and the Zone 7 Connection Fee for the new meter <br /> according to the Fee Schedule in effect at that time. Any service lateral upgrades will be the <br /> obligation of the Developer including all Encroachment Permit Fees and backflow prevention <br /> device testing and certification <br /> Section 3.06 School Fees. Developer shall pay school fees in accordance with a written <br /> agreement entered into, or to be entered into, between Developer and the Pleasanton Unified <br /> School District("PUSD"), and Developer shall provide to City, prior to building permit issuance, <br /> PUSD's written confirmation of such agreement. <br /> Section 3.07 Tri-Valley Transportation Council Fee. The Developer shall pay the Tri-Valley <br /> Transportation Council fee prior to building permit issuance. <br /> Section 3.08 Traffic Mitigation Measures. <br /> PHASE 1 TRAFFIC IMPACT ANALYSIS("TIA")MITIGATION MEASURES: The Developer <br /> shall comply with the mitigation measures identified in the Project TIA,prepared by Fehr& Peers <br /> dated March 2021,to the reasonable satisfaction of the City's Traffic Engineer. These mitigation <br /> measures are the following provisions: <br /> a. Construct a westbound buffered bike lane on Stoneridge Drive or alternate facility if <br /> approved by the City's Traffic Engineer along the Property frontage(Mitigation 1 in TIA). <br /> b. Construct "cycle track" facility along the northern Property frontage that is adjacent to <br /> Stoneridge Mall Road or alternate facility if approved by the City's Traffic Engineer <br /> (Mitigation 2 in TIA) <br /> a. The cycle track will include modifications at both adjacent intersections to allow <br /> for safe access and egress. <br /> c. Construct a mixed-use path along the east side of the Property (Mitigation 2 in TIA.) <br /> Construct improvements at Stoneridge Mall Road and Genomics Place.
