Chair Brown stated the dome height was acceptable. He agreed with Commissioner Ritter on <br /> the building height and requested the applicant explain the heights over 30 feet. <br /> Conclusion Discussion Point#5 <br /> 5. Is there additional information needed to assist the Commission in its decision on the <br /> proposal? <br /> Commissioner Allen stated she was very impressed with the project and thanked the <br /> community for its support and applicant for the beautiful design. <br /> Commissioners Gaidos and Pace echoed Commissioner Allen. <br /> Commissioner Ritter stated he loved the community benefits provided by this project. <br /> Commissioner Nibert echoed the other Commissioners. <br /> Chair Brown thanked all the speakers and stated he liked the proposal. <br /> 5. P21-0136, Jonathan James/William Wood Architects for Chabad of the Tri-Valley, <br /> 3370 Hopyard Road — Public Hearing to discuss an application for Design Review <br /> approval to modify the building facade, construct a new playground and outdoor terraces, <br /> and install on-site improvements including a new trash enclosure and new landscaping. <br /> Zoning District is Multi-Family Residential (RM-25). <br /> Associate Planner Jenny Soo presented the specifics of the item in the Agenda Report. <br /> Commissioner Allen discussed concerns raised regarding start and stop in the work based on <br /> funding and asked staff to comment. Ms. Clark explained that conditions of approval regarding <br /> timeframe of completion were not usually imposed; rather staff relied on the Municipal Code <br /> related to expiration of permits, typically a year. <br /> Commissioner Allen asked if in the original conditions of approval prevented the daycare <br /> center from opening prior to completion of the exterior improvements. Ms. Soo explained that <br /> the playground needed to be in place pursuant to State licensing requirements for childcare <br /> facilities. She stated the building tenant improvements had to be completed based on Fire and <br /> Building Codes in order to open the daycare. <br /> Commissioner Pace clarified that the application before the Commission was to change the <br /> facade of the building. Ms. Soo confirmed. <br /> Commissioner Ritter asked why the item was before the Commission. Ms. Soo stated staff <br /> found the change in building elevations to be significant. Commissioner Ritter asked if the <br /> height changes were outside the zoning for the area. Ms. Soo stated they were not. <br /> Commissioner Ritter asked who decided the changes were "significant."
