P21-0136, Jonathan James/William Wood Architects for Chabad of the Tri-Valley, 3370 Hopyard Road — Public Hearing to discuss an application for Design Review approval to modify the building facade, construct a new playground and outdoor terraces, and install on-site improvements including a new trash enclosure and new landscaping. Zoning District is Multi-Family Residential (RM-25). Associate Planner Jenny Soo presented the specifics of the item in the Agenda Report. Commissioner Allen discussed concerns raised regarding start and stop in the work based on funding and asked staff to comment. Ms. Clark explained that conditions of approval regarding timeframe of completion were not usually imposed; rather staff relied on the Municipal Code related to expiration of permits, typically a year. Commissioner Allen asked if in the original conditions of approval prevented the daycare center from opening prior to completion of the exterior improvements. Ms. Soo explained that the playground needed to be in place pursuant to State licensing requirements for childcare facilities. She stated the building tenant improvements had to be completed based on Fire and Building Codes in order to open the daycare. Commissioner Pace clarified that the application before the Commission was to change the facade of the building. Ms. Soo confirmed. Commissioner Ritter asked why the item was before the Commission. Ms. Soo stated staff found the change in building elevations to be significant. Commissioner Ritter asked if the height changes were outside the zoning for the area. Ms. Soo stated they were not. Commissioner Ritter asked who decided the changes were "significant." Ms. Soo explained staff's rationale, which was that the proposed design changes the entire appearance of the existing building, so it looks like a different building.
