ATTACHMENT 1 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING THE MAYOR TO EXECUTE TWO RIGHT-OF-WAY CONTRACTS AND GRANT TWO TEMPORARY CONSTRUCTION EASEMENTS TO THE ALAMEDA COUNTY TRANSPORTATION COMMISSION FOR THE 1-680 SOUTHBOUND EXPRESS LANES BETWEEN STATE ROUTE 84 AND ALCOSTA BOULEVARD PROJECT WHEREAS, the Alameda County Transportation Commission (ACTC) is the Implementing Agency for the 1-680 Southbound Express Lane Between State Route 84 and Alcosta Boulevard (the "Project"); and WHEREAS, in order to construct the project ACTC is requesting to grant them approximately 15-foot wide Temporary Construction Easements (TCEs) along the edge of two city-owned properties adjacent to the 1-680; and WHEREAS, the two city-owned properties have Alameda County Assessor Parcel Numbers 941-1000-5 and 946-4590-8-2; and WHEREAS, the two city properties are vacant open space lands adjacent to freeway with no plans for any type of development; and WHEREAS, ACTC has offered a payment totaling $8,600 for the 30 months the Temporary Construction Easements are required; and WHEREAS, ACTC has prepared a Right-of-Way Contract for each Temporary Construction Easement requested; and WHEREAS, ACTC has prepared a Grant Deed for each Temporary Construction Easement requested. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Authorizes the Mayor to execute Right-of-Way Contract with ACTC for each TCE requested, subject to minor modifications by the City Manager as approved by the City Attorney. SECTION 2. Authorizes the Mayor to grant the two TCEs to ACTC, subject to minor modifications by the City Manager as approved by the City Attorney, as well as other necessary related documents.
