Recorded at the request of: <br /> ALAMEDA COUNTY TRANSPORTATION COMMISSION <br /> Return to: <br /> Deputy Executive Director of Projects <br /> Alameda County Transportation Commission <br /> 1111 Broadway,Suite 800 <br /> Oakland,CA 94607 <br /> APN:Portion of 941-1000-5 <br /> Chicago Title Co.Order No.:FWAC-T020001684 <br /> GRANT OF TEMPORARY CONSTRUCTION EASEMENT <br /> For good and valuable consideration pursuant to that certain Right of Way Contract <br /> executed by the parties hereto, on or about the date hereof ("ROW CONTRACT"), the <br /> undersigned, CITY OF PLEASANTON, A MUNICIPAL CORPORATION ("GRANTOR"), <br /> hereby grants to ALAMEDA COUNTY TRANSPORTATION COMMISSION ("ALAMEDA <br /> CTC"), and its successors and assigns, a Temporary Construction Easement, over, across, under <br /> and through the real property situated in the County of Alameda, State of California,described in <br /> Exhibits A and B, attached hereto ("EASEMENT AREA") for public road construction and <br /> conformance purposes related to the Interstate 680(1-680)Southbound Express Lanes Project <br /> ("PROJECT"). <br /> ALAMEDA CTC's rights under the easement granted hereby shall include, without <br /> limitation,the right of ALAMEDA CTC,its officers,agents,contractors,and employees,and other <br /> governmental agencies responsible for review or construction of any portion of the PROJECT and <br /> such agencies' officers,agents,contractors,and employees,to enter upon the EASEMENT AREA <br /> with personnel, vehicles and equipment for construction of the PROJECT,and all other activities <br /> related thereto, to remove all improvements, trees and vegetation thereon that interfere with the <br /> purpose for which this easement is granted,to conform the EASEMENT AREA to the PROJECT, <br /> and do any and all other actions necessary and appropriate to the construction of the PROJECT. <br /> If improvements in the EASEMENT AREA are removed pursuant to this Temporary <br /> Construction Easement, such improvements will be reconstructed at ALAMEDA CTC's sole <br /> expense upon the termination of the Temporary Construction Easement and will be restored to <br /> their original condition or as close thereto as is feasible. If reconstruction is not feasible, <br /> ALAMEDA CTC will pay GRANTOR the value of such improvements, which payment shall be <br /> in addition to the compensation set forth in the ROW CONTRACT. <br /> This Temporary Construction Easement is for a period of 30 months, to commence upon <br /> thirty (30) days written notice from ALAMEDA CTC to GRANTOR, and shall terminate 30 <br /> months after such commencement. In the event ALAMEDA CTC desires to utilize or occupy the <br /> Temporary Construction Easement area beyond the 30-month period described above, <br /> ALAMEDA CTC shall pay GRANTOR, on a month-to-month basis, additional compensation <br /> pursuant to the provisions of the ROW CONTRACT. In no event shall this Temporary <br /> Construction Easement extend beyond the completion of construction,or December 31,2024.
