above-referenced twenty-five (25) Sewer Permits have been <br />utilized pursuant to validly issued building permits. <br /> <br /> 4. (a) Nothing contained herein shall preclude <br />Developer, its successors-in-interest or assigns, from <br />submitting plans and development proposals for the Property <br />to Pleasanton, including, but not limited to, the submission <br />of precise plans, subdivision maps and building permit <br />applications, during the period in which the issuance of <br />building permits is forbidden by this Agreement, or at any <br />other time. <br /> <br /> (b) Because of uncertainty in the development and <br />marketing of the Property resulting from lack of an adopted <br />street design for Pimlico Drive, City will give special <br />consideration to any request by Developer for cancellation <br />of this Agreement for an approved Project on the Property. <br /> <br /> 5.
