<br />JWJ:alh/m <br />1/18/84 <br />MOZART AMENDED DEVELOPMENT DEFERMENT AGREEMENT <br />THIS AMENDED AGREEMENT is entered into this oC ~~~l, <br />day of January, 1984, by and between FOOTHILL ENTERPRISES, a <br />California General Partnership ("Foothill"), MOZART <br />DEVELOPMENT COMPANY, a California corporation ("Mozart") and <br />the CITY OF PLEASANTON, a municipal corporation ("City"). <br />RECITALS <br />This Amended Development Deferment Agreement is <br />entered into on the basis of the following facts, <br />understandings and intentions of the parties: <br />A. Foothill owns Parcels A and B, as such Parcels are <br />shown on Parcel Map 3701 ("parcel Map"), filed May 24, 1982, <br />in Book 133 of Parcel Maps, Pages 70-72, inclusive, of <br />Alameda County Records ("Parcel A" and "Parcel B"). SAB <br />Investment Company, a general partnership ("SAB") owns <br />Parcel C as such parcel is shown on the Parcel Map ("Parcel <br />C"). Tentative Parcel Map 3702 was approved by the City of <br />Pleasanton (subject to certain conditions) on December 9, <br />1983, for a subdivision of Parcel A into two (2) parcels <br />("Parcel 1" and "Parcel 2"). Tentative Parcel Map 3702 is <br />attached hereto as Exhibit A and shows Parcels A, B and C <br />and the proposed subdivision of Parcel A into Parcel 1 and <br />Parcel 2. <br />
