In response to Councilmember Balch's inquiry, Senior Planner Bonn confirmed the 1,200 square foot <br /> limit has been in the Pleasanton Municipal Code since at least 2000 and believes it has been state law <br /> even longer. He requested an amendment to the motion to keep the 1,200 square foot limit considering <br /> its 20-year existence in the City. <br /> Councilmember Testa reported several homeowners associations appealed to her to keep the owner- <br /> occupancy requirements and not lose this understood expectation. <br /> In response to Councilmember Balch's inquiry, City Attorney Sodergren stated he was only familiar with <br /> owner-occupancy requirements for the City and not HOAs and CC&Rs. <br /> In response to Councilmember Arkin's inquiry, Director Clark confirmed there would be no design <br /> review with the 1,200 square foot allowance. Councilmember Arkin advised this is why she is against <br /> the limit as 1,200 square feet is substantially larger and the affordability component gets lost in an ADU <br /> that large. She denied Councilmember Balch's amendment. <br /> In response to Councilmember Testa's inquiry, Assistant City Manager Dolan confirmed the pre- <br /> approved designs are included in the motion. <br /> MOTION: It was m/s by Arkin/Brown to introduce and waive full reading of Ordinance No. 2213 <br /> approving amendments to Chapters 18.08, 18.28, 18.32, 18.36, 18.44, 18.46, 18.84, 18.88 and 18.106 <br /> of the Pleasanton Municipal Code to comply with state legislation for accessory dwelling units with <br /> second story ADUs limited to 16 feet, except for where mandated by law and in PUDs, a 10-foot <br /> setback for ADUs on corner lots, staff's recommended landscaping and fencing guidelines, pre- <br /> approved designs, State's ADU size restrictions of 850 square feet for a one-bedroom ADU and 1,000 <br /> square feet for a two-bedroom ADU, change the terminology from "any" to "all" in the, maintain deed <br /> restrictions on ADUs approved prior to 2020, and make the finding that amendments are exempt from <br /> environmental review. Motion passed by the following vote: <br /> Ayes: Councilmembers Arkin, Testa, Mayor Brown <br /> Noes: Councilmembers Balch, Narum <br /> Absent: None <br /> Mayor Brown recessed the meeting at 9:47 p.m. and resumed the meeting at 9:53 p.m. <br /> 18. Receive update regarding City's COVID-19 response and recovery actions and provide direction <br /> on additional face coverings compliance <br /> City Manager Fialho provided a brief overview of the item and reported the City declared a local <br /> emergency on March 17, 2020, focusing on public welfare, the health and safety of City employees and <br /> the community, protecting and maintaining City assets, disseminating accurate and timely information <br /> to City employees and the public, and re-entry and recovery. He reported the City's web-traffic is at an <br /> all-time high as residents look for updates. <br /> City Manager Fialho identified four key Council actions taken: supporting County and State limitations <br /> on residential and commercial evictions; fully funding non-profit housing, human services, and <br /> community grant requests for over $1.1 million; approving an augmented Business Support Program <br /> and loan fund which has issued 109 loans for a sum of over $1.2 million; and approval of a rental <br /> assistance program, giving 207 households a total of $643,857. <br /> City Manager Fialho detailed collaborative initiatives the City has taken along with Dublin, Livermore, <br /> and Alameda County including a regional testing site that has administered over 29,000 COVID-19 <br /> tests, a regional food distribution center averaging over 700 households weekly, 70% of which qualify <br /> as extremely low income, and a regional vaccination site set to open February 17th.
