In response to Councilmember Testa's inquiry, Management Analyst Reda confirmed EBCE would <br /> carry the subsidy for those receiving assistance. Mr. DiGiorgio specified the discount for those receiving <br /> assistance is ratepayer funded regardless of the specific power company. He added the 1% discount <br /> for Bright Choice 100 is provided by EBCE. <br /> Councilmember Testa expressed her support of the program and encouraged community education <br /> about the change. <br /> In response to Councilmember Balch's inquiry, Mr. DiGiorgio stated a customer can change their type <br /> of EBCE service every couple of billing cycles; if customers opt-out of EBCE after 60 days of service, <br /> they must wait one year to return to EBCE. <br /> MOTION: It was m/s by Narum/Testa to adopt and waive full reading of Resolution No. 21-1197 <br /> authorizing the City Manager to purchase Renewable 100 as the default electricity product for <br /> Pleasanton's municipal accounts and designating Brilliant 100 as the default product for residential, <br /> commercial, industrial accounts. Motion passed by the following vote: <br /> Ayes: Councilmembers Arkin, Balch, Narum, Testa, Mayor Brown <br /> Noes: None <br /> Absent: None <br /> 16. Public Hearing: Consider introduction and waive first reading of an ordinance approving <br /> amendments to Chapters 18.08, 18.28, 18.32, 18.36, 18.44, 18.46, 18.84, 18.88, and 18.106 of <br /> the Pleasanton Municipal Code to comply with state legislation for accessory dwelling units; and <br /> adoption of a resolution amending the Master Fee Schedule for accessory dwelling units <br /> Community Development Director Ellen Clark stated it has been a year since the State passed <br /> legislation covering accessory dwelling units (ADUs). She noted staff and the Planning Commission <br /> have been working through the new provisions and have this proposal to meet the new regulations <br /> while protecting neighborhood quality. <br /> Senior Planner Shweta Bonn clarified an ADU is an independent living unit on a property where there is <br /> already a main living unit. She added a Junior ADU (JADU) is a unit contained within the space of an <br /> existing dwelling that does not have to have its own amenities such as restrooms and a kitchen and is <br /> limited to 500 square feet. She noted the State has passed legislation in recent years encouraging <br /> ADUs, so the Pleasanton Municipal Code (PMC) needs to be amended to incorporate those new laws. <br /> Senior Planner Bonn detailed different types of ADUs — attached, second story attached, detached, <br /> second story detached, and conversion of existing space. She added there is a new State Exemption <br /> ADU declaring the City must allow an ADU of at least 800 square feet in size, up to 16 feet in height, <br /> and with a four-foot setback from the rear and side property lines. She noted the PMC's guidance <br /> would apply to any ADUs which exceed these markers. <br /> Senior Planner Bonn stated the State laws state a single-family development can have up to one ADU <br /> and one JADU. She added a multifamily development can have non-habitable portions converted to <br /> ADUs at a maximum of 25% of the existing units in each structure or two detached ADUs. <br /> Senior Planner Bonn added owner-occupancy is not required for a single-family residence ADU but is <br /> for a JADU. She added a JADU must have a rental period longer than 30 days. She noted the State <br /> laws now require City action within 60 days of an application or it is automatically approved. <br /> Senior Planner Bonn noted on owner-occupancy. the Planning Commission recommends no owner- <br /> occupancy be required for an ADU regardless of when they were approved whereas the State law only <br /> requires this for ADUs approved since 2020. She added the Planning Commission would maintain the <br /> requirement with a JADU. She added support for allowing a primary residence and ADU to be rented to <br /> City Council Minutes Page 5 of 17 January 19, 2021 <br />
