RESOLUTION NO. 21-1203 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING THE MAYOR TO EXECUTE THE GRANT OF A UTILITY DISTRIBUTION EASEMENT TO PACIFIC GAS AND ELECTRIC ACROSS THE LIVERMORE PLEASANTON FIRE STATION NO. 3 PROPERTY LOCATED AT 3200 SANTA RITA ROAD TO PROVIDE GAS AND ELECTRIC SERVICES TO THE PROPERTY WHEREAS, City is demolishing and reconstructing the Livermore Pleasanton Fire Station No. 3 (the "Project"); and WHEREAS, Pacific Gas and Electric will supply gas and electric utilities to the project site requiring equipment be located in close proximity to the project site; and WHEREAS, land space on the small project site is limited; and WHEREAS, a design goal of the project is to make pedestrian and motorist views of the finished project from West Las Positas and Santa Rita Road attractive, and WHEREAS, the required Pacific Gas and Electric equipment located in the public right of way on either West Las Positas or Santa Rita will is inconsistent with the aesthetic goal. WHEREAS, City has proposed a location for the equipment on the site that does not interfere with station operations and is out of public view, and WHEREAS, Pacific Gas and Electric has agreed to the location but requires a utility distribution easement granting rights to install and operate their equipment in the identified. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Authorizes the Mayor to execute the Utility Distribution Easement, as generally shown in the Exhibit One, subject to minor modifications by the City Manager as approved by the City Attorney. as well as other necessary related documents. SECTION 2. This resolution shall become effective immediately upon its passage and adoption. SECTION 3. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on March 2, 2021.
