PUBLIC PARTICIPATING JURSIDICTION AGREEMENT <br />between the <br /> CITY OF FREMONT, CITY OF PLEASANTON, <br /> And COUNTY of ALAMEDA <br /> <br /> THIS AGREEMENT, is made and entered into as of this 9th day of December, 2003, <br />between the City of Fremont, City of Pleasanton, and the County of Alameda, hereinai~er <br />referred to as PARTICIPATING PUBLIC JURISDICTIONS (PPJs). <br /> <br /> WHEREAS, the PARTICIPATING PUBLIC JURISDICTIONS recognize the need for <br />low-income housing to serve homeless persons and families in Alameda County; and <br /> <br /> WHEREAS, the PARTICIPATING PUBLIC JURISDICTIONS ail have ailocated funds <br />from their respective HOME funding sources in order to fund the Housing Alliance Project; and <br /> <br /> WI~EREAS, the PARTICIPATING PUBLIC JURISDICTIONS recognize the <br />desirability and efficiency of coordinating their efforts in order to monitor the provision of and to <br />fund the acquisition and developmem of the Alliance Project; and <br /> <br /> WWEREAS, Alameda County Housing and Community Development Depa~h.ent, as <br />lead agency in the Alameda County HOME Consortium, agrees to act as Lead agency for the <br />Housing Alliance Project and administer the HOME funding from the Participating Public <br />Jurisdictions for this project; <br /> <br />NOW, TNE~REFORE, the parties hereto do mutually agreement as follows: <br /> <br />The parties to this Agreement agree to fund the acquisition and development of a 28-unit <br />affordable multi-family complex for formerly homeless persons and families. The units <br />will be constructed according to universal design parameters to accommodate a variety of <br />households with different disabilities and chailenges. This housing, known as the <br />Housing Alliance Project, will be located on the Property generaily described as 22198- <br />22200 Center Street, Castro Vailey, in Alameda County, (the "Property") more <br />specificaily described in Exhibit A, attached hereto and incorporated here by reference. <br /> <br />Title to the Property acquired in whole or in part under this Agreement, shall vest with <br />Allied Housing, Inc. (Allied) subject to the condition that Allied shall use the property for <br />the authorized purpose stated in Section 1. <br /> <br />Allied Housing shall retain the Property acquired with funds under this Agreement as <br />long as there is a need for the use of such Property for formerly homeless persons and <br />families with disabilities. Recognizing that the need, or other circumstances may change, <br />Allied Housing shall request disposition instructions from the County subject to the <br />conditions of the Regulatory Agreement. The County shail consult with the other PPJs <br />and have approval from then~ on all proposed dispositions and/or changes of use for the <br /> <br />Page 1 of 7 <br /> <br /> <br />
