PUBLIC PARTICIPATING JURISDICTION AGREEMENT

PUBLIC PARTICIPATING JURSIDICTION AGREEMENT between the CITY OF FREMONT, CITY OF PLEASANTON, And COUNTY of ALAMEDA THIS AGREEMENT, is made and entered into as of this 9th day of December, 2003, between the City of Fremont, City of Pleasanton, and the County of Alameda, hereinai~er referred to as PARTICIPATING PUBLIC JURISDICTIONS (PPJs). WHEREAS, the PARTICIPATING PUBLIC JURISDICTIONS recognize the need for low-income housing to serve homeless persons and families in Alameda County; and WHEREAS, the PARTICIPATING PUBLIC JURISDICTIONS ail have ailocated funds from their respective HOME funding sources in order to fund the Housing Alliance Project; and WI~EREAS, the PARTICIPATING PUBLIC JURISDICTIONS recognize the desirability and efficiency of coordinating their efforts in order to monitor the provision of and to fund the acquisition and developmem of the Alliance Project; and WWEREAS, Alameda County Housing and Community Development Depa~h.ent, as lead agency in the Alameda County HOME Consortium, agrees to act as Lead agency for the Housing Alliance Project and administer the HOME funding from the Participating Public Jurisdictions for this project; NOW, TNE~REFORE, the parties hereto do mutually agreement as follows: The parties to this Agreement agree to fund the acquisition and development of a 28-unit affordable multi-family complex for formerly homeless persons and families. The units will be constructed according to universal design parameters to accommodate a variety of households with different disabilities and chailenges. This housing, known as the Housing Alliance Project, will be located on the Property generaily described as 22198- 22200 Center Street, Castro Vailey, in Alameda County, (the "Property") more specificaily described in Exhibit A, attached hereto and incorporated here by reference. Title to the Property acquired in whole or in part under this Agreement, shall vest with Allied Housing, Inc. (Allied) subject to the condition that Allied shall use the property for the authorized purpose stated in Section 1. Allied Housing shall retain the Property acquired with funds under this Agreement as long as there is a need for the use of such Property for formerly homeless persons and families with disabilities. Recognizing that the need, or other circumstances may change, Allied Housing shall request disposition instructions from the County subject to the conditions of the Regulatory Agreement.
