GROWTH MANAGEMENT AGREEMENT is made and entered into on <br />thejt y day by and between THE CO Y OF <br />ALAME~hereinaf~e~-r~ferfea to as "Developer"), and the CITY OF <br />PLRASANTON, a municipal corporation (hereinafter referred to as <br />"City"). <br /> <br />RECITALS: <br /> <br /> A. Developer owns real property in the City of Pleasanton <br />described in Exhibit A, attached to this Agreement and made a part <br />of it by reference, hereinafter referred to as the "Subject <br />Property". <br /> <br /> B. The city has granted <br />approval for 152 dwelling units, <br />"Project". <br /> <br />to Developer development plan <br />hereinafter referred to as the <br /> <br /> C. Developer is seeking growth management approval for 'the <br />Project under the city's Growth Management Program. <br /> <br /> D. City may enter into growth management agreements with <br />project developers meeting the requirements for such agreements <br />pursuant to the City's Growth Management Program. <br /> <br /> E. City and Developer wish to enter into a growth management <br />agreement in order to achieve the benefits of the Project to City <br />and its residents and in accordance with the purposes of Section <br />17.36.200 of the Pleasanton Municipal Code. <br /> <br /> <br />
