ANALYSIS <br /> Conditional uses are those uses which, by their nature, require special consideration so they <br /> may be located properly with respect to the objectives of the Municipal Code and their effects <br /> on surrounding properties. To achieve these purposes, the Planning Commission is <br /> empowered to approve, conditionally approve, or deny applications for use permits. <br /> General Plan Consistency <br /> The subject site is designated by the Land Use Element of the Pleasanton General Plan for <br /> "Business Park (Industrial/ Commercial and Office) and Mixed Use" land uses, which allow for <br /> a wide range of commercial and office uses consistent with the Zoning Ordinance. The <br /> proposed project is consistent with this land use designation as it would provide a private <br /> school to serve residents of Pleasanton and the surrounding areas. <br /> Staff believes the proposed project is also consistent with the General Plan Land Use and <br /> Public Facilities and Community Programs Policies and Programs listed below, as the <br /> proposed project will: (1) introduce more activity to the subject site with new commercial uses; <br /> and (2) introduce a commercial use into Hacienda where other similar commercial uses <br /> operate; and (3) supports additional private educational opportunities for the community. <br /> Land Use: Sustainability <br /> Program 2.2: Encourage the reuse of vacant and underutilized parcels and buildings <br /> within existing urban areas. <br /> Land Use: Industrial, Commercial and Office <br /> Policy 13: Ensure that neighborhood, community, and regional commercial centers <br /> provide goods and services needed by residents and businesses of <br /> Pleasanton and its market area. <br /> Public Facilities and Community Programs: Schools and Education <br /> Policy 7: Encourage and support high quality public and private educational <br /> facilities in Pleasanton and facilitate lifelong educational opportunities for <br /> all ages. <br /> Land Use and Zoning <br /> The subject site, which is within Hacienda, is zoned PUD-I/C-O (Planned Unit Development- <br /> Industrial/Commercial-Office) district, and is in the OMPD (Mid-rise Planning District) <br /> of Hacienda, which conditionally allows private schools with more than 20 students in the <br /> facility at one time. The applicant has requested a CUP approval to allow up to 40 students at <br /> one time. If the CUP is granted, the proposed private school would be consistent with the <br /> applicable land use regulations. <br /> One of the primary concerns in reviewing a CUP application is the effect of a proposed use on <br /> the surrounding uses. When the proposed use is educational, institutional, or recreational, staff <br /> evaluates whether that use is compatible with the surrounding uses. The uses on and around <br /> the site include residential, research and development facilities and multi-tenant office uses. <br /> P20-0992, 4301 Hacienda Drive, Suite 120 Planning Commission <br /> 5 of 7 <br /> 2 of 3 <br />be consistent with the City's ability to regulate zoning as <br /> listed in Chapter 18.124 of the Municipal Code. In addition, the Planning <br /> affect the surrounding uses or <br /> properties and recommends the Planning Commission approve the project. However, <br /> alternatives to the proposal that could be considered by the Planning Commission include: <br /> 1 . Denial of the application.
