ATTACHMENT 1 SIXTH AMENDMENT TO AGREEMENT This Sixth Amendment to Agreement ("Sixth Amendment") is entered January 1 , 2021 by the City of Pleasanton ("City") and Monte Vista Memorial Investment Group (MVMIG), LLC, a Limited Liability Corporation whose address is 3656 Las Colinas Road, Livermore, CA 94551 , and telephone number is 408-499-2197 ("Contractor"). Whereas, City and Contractor entered into a Professional Services Agreement for burial services, marker installation, and ground maintenance services on December 7, 2016, as amended by the First Amendment dated November 17, 2017, the Second Amendment dated December 27, 2017, the Third Amendment dated February 5, 2019, the Fourth Amendment dated January 1 , 2020, and the Fifth Amendment dated January 21 , 2020 (collectively the "Agreement"); and Whereas, Section 3 of the Agreement allows the parties to extend the term for one final year; and Whereas, the parties desire to so extend the term of the Agreement, and provide for additional compensation for grounds maintenance and irrigation maintenance for such final year extension. Now, therefore, in exchange for valuable consideration, the receipt of which is hereby acknowledged, the parties agree as follows: A. Section 3. of the Agreement, "Terms" is amended to read: "The Agreement shall commence on January 1 , 2017 and shall expire on December 31 , 2021 ." B. Section 4. of the Agreement, "Compensation" is amended to provide for an additional $67,080 for calendar year 2021 to be billed monthly at: $5,200 per month for grounds maintenance and $390 per month for irrigation maintenance. This additional maintenance compensation for calendar year 2021 is in addition to the compensation already provided for in the Agreement for burial services, marker installation, the one-time $ 12,000 administrative fee, and any extra work up to $ 15,000 approved by the City's Parks Maintenance Superintendent. Other than as amended above, the Agreement remains in full force and effect.
