RESOLUTION NO. 20-1188 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DIRECTING <br /> THE CITY ATTORNEY TO DRAFT, AND AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE, AMENDMENTS TO: THE DISPOSITION, DEVELOPMENT AND LOAN <br /> AGREEMENT; AFFORDABLE HOUSING REGULATORY AGREEMENT AND <br /> DECLARATION OF RESTRICTIVE COVENANTS; AND GROUND LEASE WITH <br /> SUNFLOWER IRBY, LLC TO DECREASE THE NUMBER OF STAFF UNITS FROM <br /> TWO TO ONE, AND RENT THE RELEASED STUDIO UNIT TO A QUALIFIED PERSON <br /> AT 60% OF AREA MEDIAN INCOME (AMI) <br /> WHEREAS, the Sunflower Hill Project is housing for individuals with special needs, which <br /> the City has supported with a lease of public property dedicated as part of the Irby Ranch project, <br /> a loan from the City's lower-income housing fund (LIHF), and a portion of the City's share of <br /> Alameda County Measure Al funds for affordable housing projects; and, <br /> WHEREAS, Sunflower Hill has partnered with Satellite Affordable Housing Associates <br /> (SAHA), an experienced affordable housing developer, which has entered into with the City a <br /> Disposition, Development and Loan Agreement, a Regulatory Agreement, and a Ground Lease <br /> as Sunflower Irby LLC, a limited partnership for which SAHA is part of the partnership structure; <br /> and, <br /> WHEREAS, SAHA has requested amendments to those agreements to make the project <br /> more financially supportable in the long-term by having the City approve a decrease in the number <br /> of staff units from two to one, with the released studio unit then rented to a qualified person at <br /> 60% of area median income (AMI). As the proposed change would still have staff on-site to serve <br /> and assist special needs residents, it is recommended that the City Council approve such <br /> amendments. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1: Directs the City Attorney to prepare amendments to the Disposition, <br /> Development and Loan Agreement; Affordable Housing Regulatory Agreement and Declaration <br /> of Restrictive Covenants; and Ground Lease with Sunflower Irby, LLC, to decrease the number <br /> of staff units from two to one, and rent the released studio unit to a qualified person at 60% of <br /> area median income (AMI). <br /> SECTION 2: Finds that the amendments are exempt from review under the California <br /> Environmental Quality Act (CEQA) pursuant to Guideline 15061(b)(3)) as there is no possibility <br /> that the amendments in question may have a significant effect on the environment, <br /> SECTION 3: Authorizes the City Manager, Nelson Fialho, to sign the amendments on <br /> behalf of the City. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on December 1, 2020. <br />
