CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-021 <br /> <br />RESOLUTION AUTHORIZING AN APPLICATION WITH THE <br />METROPOLITAN TRANSPORTATI ON COMMISSION (MTC) FOR $77,254 IN <br />TDA ARTICLE 3 FUNDS FOR PEDESTRIAN AND EQUESTRIAN TRAIL <br />PROJECT <br /> <br />WHEREAS, the Metropolitan Transportation Commission (MTC) requires a resolution of <br /> support for Transportation Development Act (TDA) applications; and <br /> <br />WHEREAS, <br /> <br />Article 3 of the Transportation Development Act (TDA), Public Utilities Code <br />(PUC) Section 99200 et seq., authorizes the submission of claims to a regional <br />transportation planning agency for the funding of projects exclusively for the <br />benefit and/or use of pedestrians and bicyclists, and <br /> <br />WHEREAS, City's Staff Traffic Committee have reviewed various projects, and <br /> <br />WHEREAS, the Happy Valley Open Space Project (the Project) will promote pedestrian and <br /> bicycle travel; and <br /> <br />WHEREAS, <br /> <br />the Pleasanton City Council finds as follows: <br /> 1. There are no legal impediments regarding the Project. <br />2. City staffing resources are adequate to complete the Project. <br />3. There is no pending or threatened litigation that might adversely affect the <br /> Project of the ability of the City to carry out the Project. <br />4. Environmental and right-of-way issues have been reviewed and found to be in <br /> such a state that fund obligation deadlines will not be jeopardized. <br />5. Adequate local funding is available to complete the Project. <br />6. The Project has been conceptually reviewed to the point that all contingent <br /> issues have been considered; and <br /> <br />WHEREAS, the Project is categorically exempt under the requirements of CEQA. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br /> AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The Pleasanton City Council authorizes submittal of the Project application and <br />subsequent submittal of claims for payment. <br /> <br /> <br />
