CITY OF PLEASANTON <br /> CITY COUNCIL MEETING MINUTES <br /> August 18, 2020 <br /> This meeting was conducted in accordance with Governor Newsom's <br /> Executive Orders N-25-20 COVID-19 pandemic protocols. <br /> Mayor Thorne called the teleconferenced regular meeting of the City Council from various remote <br /> locations to order at the hour of 7:00 p.m. Councilmember Pentin led the Pledge of Allegiance and <br /> provided opening remarks. <br /> ROLL CALL <br /> Present: Councilmembers Brown, Narum, Pentin, Testa, Mayor Thorne <br /> Absent: None <br /> AGENDA AMENDMENTS - None <br /> CONSENT CALENDAR <br /> In response to Councilmember Brown's inquiry, City Manager Nelson Fialho explained Item 1 is a one- <br /> year program that can be renewed annually by the City Council. <br /> In response to Councilmember Brown's inquiry, Assistant City Attorney Larissa Seto clarified the <br /> language regarding no new tobacco retail stores or licenses within 1,000 feet of a youth-centered park <br /> or school is in Item 4 under Section 18.109.030. <br /> In response to Councilmember Pentin's inquiry, Housing Manager Steve Hernandez explained the <br /> administrative costs for Habitat for Humanity is roughly 26% of the budget and their staff is completing <br /> work including processing applications and completing inspections. City Manager Fialho noted hiring <br /> internal staff would cost the City more money. Additionally, he noted part of the problem with the <br /> program is there are too many barriers to obtaining the loan. <br /> In response to Councilmember Testa's inquiry, Assistant City Attorney Seto clarified the grandfathering <br /> language is located in Item 4, Section 18.109.030—Zoning Prohibition. <br /> Councilmember Testa expressed clarification as her no vote is reflected on Item 5 and not Item 4. <br /> Councilmember Brown provided her recollection of the City Council discussion and recalled <br /> grandfathering would be added to Item 5. <br /> City Manager Fialho expressed his confidence the City Attorney's Office has prepared Item's 4 and 5 <br /> with City Council's direction on both the Ordinance and the Tobacco Retailer License (TRL) program. <br /> City Attorney Daniel Sodergren clarified Councilmembers cannot change their vote from the first <br /> reading and introduction of the ordinance but can vote differently on these items since it is a separate <br /> action item. <br /> Councilmember Testa expressed concern changing her vote since she has not had an opportunity to <br /> review the minutes. Councilmember Brown opined that the votes do not change the intent of the <br /> ordinance which includes a ban on tobacco retailers 1,000 feet from schools and youth-centered parks. <br /> Councilmember Brown would also like to see the City of Pleasanton join 157 other California cities in <br /> support of the statewide ban of flavored tobacco. <br />
