t <br /> Attachment 1 <br /> b. All self-insurance, self-insured retentions, and deductibles must be <br /> declared and approved by the City. <br /> c. Evidence of Insurance - Prior to commencement of work, the Operator <br /> shall furnish the City with certificates, additional insured endorsements, <br /> and waivers of subrogation evidencing compliance with the insurance <br /> requirements above. The Operator must agree to provide complete, <br /> certified copies of all required insurance policies if requested by the <br /> City. <br /> d. Subcontractors and Consultants - A category of risk and the applicable <br /> insurance requirements will be determined on a"per subcontractor" or <br /> "per consultant"basis, considering the particular work to be done by the <br /> subcontractor or consultant and the interrelationship of that work to <br /> other work being conducted by the Operator. <br /> 7. Operator to Lease Vehicles from the City: Operator shall lease vehicles from the City for$1.00 <br /> per year, per vehicle that are necessary to perform the service. All maintenance shall occur on the <br /> Operator's property, and vehicle maintenance shall be the sole responsibility of the Operator. <br /> 8. Independent Operator. The Operator is an independent operator retained by the City to perform <br /> the work described herein. All personnel employed by the Operator, including subcontractors, <br /> and personnel of said subcontractors, are not and shall not be employees of the City. Operator <br /> has no authority to contract or enter into any other agreement in the name of City. Operator has, <br /> and hereby retains, full control over the employment, direction, compensation and discharge of <br /> all persons employed by Operator who are assisting in the performance of services under this <br /> Agreement. Operator shall be fully responsible for all matters relating to the payment of its <br /> employees, including compliance with social security, withholding tax and all other laws and <br /> regulations governing such matters. Operator shall be responsible for its own acts and those of its <br /> agents and employees during the term of this Agreement. <br /> Notwithstanding any other agency, state or federal policy, rule, regulation, law or ordinance to <br /> the contrary, Operator and any of its employees, agents, and subcontractors providing service <br /> under this Agreement shall not qualify for or become entitled to, and hereby agree to waive any <br /> claims to, any compensation, benefit, or any incident of employment by City, including but not <br /> limited to eligibility to enroll in PERS as an employee of City and entitlement to any <br /> contribution to be paid by City for employer contribution and/or employee contributions for <br /> PERS benefits. <br /> 9. Miscellaneous Provisions. <br /> a. City may terminate this Agreement at any time by mailing notice to Operator at the address <br /> first stated above. Operator shall be paid for that portion of work completed when notice is <br /> received. <br />
