OF THE CITY Of PLEASANTON ALAMEDA COUNTY CALIFORNIA ORDINANCE NO. 831 AN ORDINANCE AMENDING SEC- TION 2 5.30(a) (SWIMMING POOL) OF ARTICLE 2, CHAPTER 2, TITLE II OF THE ORDINANCE CODE BY MODIFYING THE DEFINITION OF SWIMMING POOLS: AMENDING SECTION 2 544 (ACCESSORY STRUCTURES, LOCATION AND YARDS) OF ARTICLE 3, CHAPTER 2 BY ADDING SUBSECTION (e) RE LATING TO SWIMMING POOLS; AMENDING SECTION (PERMITTED USED IN THE R 1 DIS- TRICT) OF ARTICLE 5, CHAPTER 2 BY DELETING SUBSECTION (f) RE- LATING TO SWIMMING POOLS AND RENUMBERING THE REMAINING SECTIONS; AMENDING SECTION 2 6.24 (PERMITTED LJSES IN THE R M DISTRICT) OF ARTICLE 6, CHAPTER 2, BY DELETING SUB SECTION (d) RELATING TO SWIM MING POOLS AND RENUMBERING THE REMAINING SECTIONS; AND AMENDING CHAPTER 11 (SWIM MING POOLS) OF TITLE II OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON BY ADDING SEC. 2 18.3t RELATING TO APPLICA. TION & EXEMPTIONS. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: Section ]. That Section 2 5 30(a) (Swimming Pool), Article 2 (Defini tions), Chapter 2 (Zoning), Title (Zoning and Development) of the Ordinance Code of the City of Pleas anton be amended to read as roi a. Swimming Pool. A pool, pond, lake or open tank capable of con raining water to a depth greater than one and one.half feet at any point, including therapeutic pools and hot tubs, All pools shall be deemed Class II Accessory Structures. Section 2. That Section 2-5.44 (Accessory Structures: Location and Yards), Article 3 (Site, Yard, etc., Regulations), Chapter 2, Title II be amended by adding Subsection (e) as follows: e Swimming pools shall comply with the applicable Class II Accesso ry Structure regulations of this chap ter and in addition shall be subject to the requirements of Chapter 1 (Swimming Pools), Title II (Zoning and Development) Section 3. That Section 2-6.13 of Article 5 (R-1 District), Chapter Title II relating to permitted uses in the R I District shall be amended by deleting Subsection (f) relating to swimming pools, and renumbering Section 4. That Section 2 6.24, Article 6 (R M Multi-Eamily Residen rial District), Chapter 2, Title II relat lng to permitted uses in the R M Zone be amended by deleting Sub section (d) relating to swimming pools and by renumbering the re- maining sections. Section g. That Section 2-18,31 (Application and Exemptions) be dded to Chapter fl (Swimming ?ools), Title II (Zoning and Develop ment) to read as follows: Sec. 2 18.31 Application and Ex- emptions. This chapter shall apply to all "swimming pools" as defined in Section 2-5.30(a) The adminis- trative authority shall be empowered to exempt any structures covered by this section from any provisions of this chapter which, when applied to them, would be unreasonable. The administrative authority shall make and keep a record of all such exemp. tions. Section 6. This ordinance shall become effective thirty (30) days after the date of its final passage and adoption. This ordinance shall be published once within fifteen (]5) days alter its adoption in "THE TIMES," a newspaper of general cir culation, published in the City of Pleasanton, INTRODUCED at a regular meet ing of the city Council of the City ol Pleasanton on August 23, 1977.
