CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. 831 <br /> <br />AN ORDINANCE AMENDING SECTION 2-5.30(~) (SWIMMING POOLI OF ARTICLE <br />2, CHAPTER 2, TITLE II OF THE ORDINANCE CODE BY MODIFYING THE <br />DEFINITION OF SWIMMING POOLS; AMENDING SECTION 2-5.44 (ACCESSORY <br />STRUCTURES: LOCATION AND YARDS) OF ARTICLE 3, CHAPTER 2 BY ADDING <br />SUBSECTION (e) RELATING TO SWIMMING POOLS; AMENDING SECTION 2-6.13 <br />(PERMITTED USES IN THE R-1 DISTRICT) OF ARTICLE 5, CHAPTER 2, BY <br />DELETING SUBSECTION (f) RELATING TO SWIMMING POOLS AND RENUMBERING <br />THE REMAINING SECTIONS; AMENDING SECTION 2~6.24 (PERMITTED USES <br />IN THE R-M DISTRICT) OF ARTICLE 6, CHAPTER 2, BY DELETING SUBSECTION <br />(d) RELATING TO SWIMMING POOLS AND RENUMBERING THE REMAINING <br />SECTIONS; AND AMENDING CHAPTER 11 (~SWIMMING POOLSI OF TITLE II <br />OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON BY ADDING ~2-18.31 <br />RELATING TO APPLICATION AND EXEMPTIONS. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. <br /> <br />That Section 2-5.30(a) (Swimming Pool}, Article 2 <br />initions), Chapter 2 (Zoning), Title II (Zoning and <br />Development) of the Ordinance Code of the City of Pleas- <br />anion be amended to read as follows: <br /> <br />Swimming Pool. A pool, pond, lake or open tank <br />capable of containing water to a depth greater <br />than one and one-half feet at any point, including <br />therapeutic pools and hot tubs. All pools shall be <br />deemed Class II Accessory Structures. <br /> <br />Section 2. <br /> <br />That Section 2~5.44 (Accessory Structures: Location <br />and Yards), Article 3 (Site, Yard, etc., Regulations), <br />Chapter 2, Title II be amended by adding Subsection <br />as follows: <br /> <br />Swimming pools shall comply with the applicable Class <br />II Accessory Structure regulations of this chapter <br />and in addition shall be subject to the requirements <br />of Chapter 11 (Swimming Pools), Title II (Zoning and <br />Development). <br /> <br />Section 3. <br /> <br />That Section 2-6.13 of Article 5 (R-1 District), Chapter <br />Title II relating to permitted uses in the RTl District <br />shall be amended by deleting Subsection (f) relating to <br />swimming pools, and renumbering the remaining sections. <br /> <br />Section 4. <br /> <br />That Section 2-6.24, Article 6 (R-M Multi-Family Resi- <br />dential District), Chapter 2, Title II relating to per- <br />mitted uses in the R-M Zone be amended by deleting Sub- <br />section (d) relating to swimming pools and by renumbering <br />the remaining sections. <br /> <br />Section 5. <br /> <br />That Section 2-18.31 (Application and Exemptions} be added <br />to Chapter 11 (Swimming Pools), Title II (Zoning and Devel- <br />opment) to read as follows: <br /> <br /> <br />
