<br />FOLLOWS:
<br /> Section 1.Pursuant to Section
<br />2 8.37 (c), the City Council rezones
<br />approximately 2.1 acres ol land Io
<br />ca:ed On the Southeast corner of the
<br />intersection of Black Avenue and
<br />Hopyard Road from the RM-4000
<br />(Multiple Residential) District to
<br />PUD (Planned Unit Development)
<br />District (as more particularly de
<br />scribed in Zoning Unit Map ;~164
<br />attached hereto and incorporated
<br />herein by reference) with a develop
<br />men: of high density residential
<br />units, in accordance with the Gener
<br />al Plan of the City of Pleasanton.
<br /> Section 2. The Zoning Map of the
<br />City of Pleasanton dated April
<br />1960, on file with the City Clerk, des
<br />ignating and dividing the City into
<br />zoning districts is hereby amended
<br />in accordance with the action set
<br />forth in Section I above.
<br /> Section 3. Zoning Unit Map No.
<br />164, Dated July 20, 1977, on file
<br />with the City Clerk of the City of
<br />Pleasanton, a copy of which is at
<br />tached hereto as Exhibit "A" and
<br />made a part hereof by reference des-
<br />ignates said land use and zonmg
<br />district,
<br /> Section 4. Pursuant to Section
<br />2 8.37 (c) and Section 2 8.35, Arti-
<br />cle 14. Chapter 2, Title II of the Ordi
<br />nance Code of the City of
<br />Pleasanton, the City Council ap
<br />proves the Development Plan con.
<br />sidered concurrently with the
<br />rezonmg application for the con-
<br />struction of a twenty-eight unit con.
<br />dominium project on the property
<br />rezonea pursuant to Section 1
<br />above. Except as otherwise provided
<br />in the conditions attached to said
<br />rezoning and said Development
<br />Plan, the Planning Division of the
<br />Department of Community and De
<br />velopment shall be guided by the
<br />provisions of the RM 4000 District
<br />as set forth in the Ordinance Code of
<br />the City of Pleasanton to administer
<br />~and use questions involving this
<br />project in the future,
<br /> Section 5. The Development Plan
<br />approved by Section 2 above shall
<br />be subject to the conditions set forth
<br />in Planning Commission Resolution
<br />No. ]519, attached hereto as Exhib.

<br />Section 6. This ordinance shall
<br />become effective thirty (30) days
<br />after the date of its final passag~
<br />and adoption.

<br />A RESOLUTION OF THE PLANNING
<br />COMMISSION OF THE CITY OF
<br />PLEASANTON RECOMMENDING TO
<br />THE CITY COUNCIL APPROVAL OF
<br />PUD 77 4.
<br />
<br />WHEREAS, Page Binkley has sub
<br />mitted application No PUD 77 4,
<br />an application to rezone approxi
<br />mately 3.1 acres on the southeast
<br />corner of Black Avenue and Hopyard
<br />Road from the RM 4000 (Multiple
<br />Residential) District to the PUD
<br />(Planned Unit Development) Dis
<br />trict; and
<br />WHEREAS, applicant has also re
<br />quested approval of a development
<br />plan tot said property to construct a
<br />28 unit condominium project; and
<br />WHEREAS, a public hearing was
<br />held on this project by the Planning
<br />Commission on May 18, 1977, at
<br />which time all pertinent maps, draw
<br />ings, documents and testimony
<br />were reviewed by the Planning Corn
<br />
<br /> NOW, THEREFORE, the Planning
<br />
<br />Section 1. The Planning Commis
<br />sion recommends to the City Coun
<br />cfi adoption of an ordinance to
<br />rezone the property as requested in
<br />PUD 77 4.

<br />filed for PUD 77 4, subject to the roi
<br />lowing conditions
<br /> ]. That the development be sub
<br />stun:fully as shown on the develop

<br />hibit B, on file with the Planning De
<br />paHment.
<br />2. That all future develol;ment on
<br />the site be in accord with the site re
<br />quirements for the RM4000 Dis
<br />trict.
<br />3. That the developer's contractor
<br />obtain an encroachment permit
<br />from the City prior to the beginning
<br />of construction
<br />4. That the site be kept free of fire
<br />hazards from start of construction
<br />to final inspection and that the Fire
<br />Division emergency number provid
<br />ed adjacent to all telephones on the
<br />site.
<br />5 That all dwelling units be con
<br />structed to meet the PG&E. Energy
<br />Conservation Nome Standards pro-
<br />mulgated by P,G.&E in 1976.

<br />number, location, size and name of
<br />all plants to the Planning Depart
<br />men: for approval prior to issuance
<br />of a building permit.

<br />trees as required per ordinance and
<br />that the type of tree be approved by
<br />the Director of Engineering Services.
<br /> 9 That any damage to street im
<br />provements now existing or done
<br />during construction on the subject
<br />property be repaired at full expense
<br />to the developer.
<br /> 10. That all utilities required to
<br />serve this development be installed
<br />underground.
<br /> ] 1 That the street numbers of all
<br />buildings be posted in such a man
<br />nar to be easily read from the street
<br />at all times, day and night.
<br /> 12. That all trees used in land

<br /> mined by the Director of Engineer.

<br /> are not necessarily limited to, grad
<br /> lng, sidewalk, water facilities, under
<br /> ground utilities and traffic control
<br /> devices.
<br /> 22. That prior to the recordin~ of
<br /> the final subdivision map for 1:his
<br /> development, all documents per-
<br /> taining to the maintenance of all
<br /> common areas on the subject prop
<br /> erty be approved by the City Attor
<br /> ney.
<br />23 That the City be identified as a
<br />third party beneficiary to the Condi.
