Paul Cummings, Alameda County Tobacco Control Program Director, expressed his support for <br />Item No. 12 and encouraged City Council pass the item. <br />Paula Lorenz expressed her support for Item No. 12 and encouraged City Council pass the item. <br />Jon Krueger expressed his support for Item No. 12 and encouraged City Council pass the item. <br />Mayor Thorne closed the public hearing. <br />MOTION: It was m/s by Brown/Testa to prohibit the sale of flavored tobacco city-wide at retailers <br />where tobacco sales are incidental but allow sales by tobacco stores where 60% or more of revenue <br />is from tobacco products and paraphernalia and entry is age restricted. Motion passed unaminously. <br />MOTION: It was m/s by Brown/Narum to prohibit the sale of electronics smoking devices and <br />paraphernalia citywide at retailers but allow sales by tobacco stores. Motion passed unaminously. <br />Councilmember Testa expressed her support for restricting all shops within 1,000 feet of public <br />schools, parks and recreation facilities. <br />MOTION: It was m/s by Narum/Pentin to prohibit tobacco sales by new retailers and new tobacco <br />stores within 1,000 feet of public schools, parks and recreation facilities, but grandfather tobacco <br />sales by existing retailers as legal non -conforming uses. Motion passed unaminously. <br />MOTION: It was m/s by Pentin/Brown to authorize the City Manager to develop and implement a <br />tobacco retailer licensing (TRL) program requiring all tobacco retailers and tobacco stores to obtain <br />an annual permit; with retailers subject to fines and permit revocation for sales violations. Motion <br />passed unaminously. <br />MOTION: It was m/s by Pentin/Narum to prohibit possession of tobacco products by persons under <br />21, subject to confiscation and diversion. Motion passed unaminously. <br />MATTERS INITIATED BY COUNCIL - None <br />COUNCIL REPORTS - None <br />ADJOURNMENT <br />There being no further business, the meeting was adjourned February 19, 2020 at 12:26 a.m. The Council <br />extended a tribute to our nation's men and women serving in the military.
