Each <br /> topic area includes the status of the current policy and an overview of where the policy <br /> differs from the recommendation of others. Staff has provided an explanation of <br /> potential policy changes. <br /> The United States Supreme Court has acknowledged that no policy can predict every <br /> possible situation an officer might encounter. Officers are entrusted to use well- <br /> reasoned discretion in determining the appropriate use of force in each incident. <br /> Policies must take into account that officers are forced to make split-second decisions in <br /> rapidly unfolding circumstances without the benefit of hindsight. According to state and <br /> federal law, all use of force is judged by the objective reasonableness standard; this <br /> standard requires use of force decisions be evaluated based on what a reasonable <br /> officer would have done in the same situation with the facts and information available to <br /> him or her at the time. <br /> The police department policy manual serves as a rule book for how it operates. Police <br /> policies must comply with laws and other mandates from both the state and federal <br /> government. A good policy also adheres to best practices as determined by subject <br /> matter experts. The Pleasanton Police Department, and most other California law <br /> enforcement agencies, contracts with Lexipol, a firm specializing in law enforcement <br /> policy, to ensure it complies with applicable laws, mandates and current best practices. <br /> What a policy does not always capture are areas where the police department exceeds <br /> what has been prescribed in its own policy.
