6 <br /> THE CITY OF <br /> -•• ••• ' CITY COUNCIL AGENDA REPORT <br /> pLEASANTON, <br /> August 18, 2020 <br /> Engineering <br /> TITLE: AUTHORIZE THE CITY MANAGER TO APPROVE A GRANT OF <br /> PRIVATE UTILITY EASEMENT WITH MAINTENANCE AND <br /> RELOCATION COVENANT ACROSS CITY-OWNED PROPERTY ON <br /> FOOTHILL ROAD FOR THE BENEFIT OF MICHAEL AND JENNIFER <br /> SEGUNDO <br /> SUMMARY <br /> On October 17, 2006, the City Council adopted Ordinance 1942, approving the rezoning <br /> of an approximately 30-acre hillside parcel located at 3459 Old Foothill Road from an <br /> agriculture district to a PUD-LDR district on eight acres, and to PUD-OS/AG district on <br /> the remaining 22 acres. At the same meeting, the City Council approved the application <br /> of Charles and Scott Austin for a PUD development plan to subdivide eight acres into <br /> lots for eight custom homes, and to deed the remaining 22 acres to the City for <br /> permanent open space. <br /> Abutting the permanent open space parcel to the west is a residential parcel currently <br /> owned by Michael and Jennifer Segundo at 3466 Old Foothill Road. The Segundos <br /> wish to extend private utilities from the eight-acre development parcel, now known as <br /> Tract 7813 "Sun Meadowlark", across the permanent open space to service their <br /> existing single-family home. The Sun Meadowlark developer has incorporated utility <br /> services into their subdivision improvements and granted a corresponding easement <br /> across Lot 5 for the private utilities. The Segundo's now need City authorization to <br /> extend the utilities across the permanent open space parcel. <br /> A Grant of Private Utility Easement with Maintenance and Relocation Covenant would <br /> grant the Segundo's the right to install and maintain private underground water, sanitary <br /> sewer, storm drain, cable television, telephone, and electricity utilities for the existing <br /> home. No above-ground structures, equipment, or other improvements would be <br /> allowed with the exception of sanitary sewer cleanouts. Any future maintenance of <br /> these utilities will require prior City approval, and the open space must be fully restored <br /> at the conclusion of any activity. The City will be fully indemnified for any of these <br /> activities. <br /> RECOMMENDATION <br /> Authorize the City Manager to approve the attached Grant of Private Utility Easement <br /> with Maintenance and Relocation Covenant. <br /> FINANCIAL STATEMENT <br /> This proposed action will have no adverse financial impact on the City. <br />
